RDINANCE N0.3250 AN ORDINANCE TO AUTHORIZE THE SUBMISSION OF A QUESTION OF PUBLIC POLICY TO THE VOTERS OF THE VILLAGE OF MOUNT PROSPECT, ILLINOIS, AT THE GENERAL ELECTION OF NOVEMBER, 1982 WHEREAS, Section 8.509 entitled "Submitting Questions of Public Policy" of Article V, Chapter 8, of the Village Code of Mount Prospect, Illinois, provides that it shall be the duty of the President and Board of Trustees of the Village to submit, by ordinance, a question of public policy to the voters of the Village, whenever a petition requesting the submission of such question of public policy has been duly and properly filed with the Village Clerk of the Village in accordance with the requirements of such Section 8.509; and WHEREAS, on the 10th day of August, 1982, being more than 78 days prior to the general election of November 2, 1982, there was submitted to the Village Clerk of the Village of Mount Prospect, Illinois, a certain Petition requesting an advisory referendum on the question of permitting resi- dential homes, including rehabilition homes in Mount Prospect, Illinois (a copy of page one of said Petition being attached hereto and made a part of this Ordinance by reference); and WHEREAS, said Petition, as submitted to the Village Clerk, was in compliance with the filing requirements set forth in Section 8.509; and WHEREAS, the Illinois Election Code requires that all questions of public policy to be submitted by ordinance must be acted upon by the corporate authorities by no later than 60 days prior to the pertinent general election. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT'AND BOARD OF TRUSTEES OF T~E VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: There shall be submitted to the electors of the Village of Mount Prospect, Cook County, Illinois, at the General Election of November 2, 1982, to be held in this Village, the following question of public policy, to-wit: "Shall ordinance No. 3198, that amended Chapter 14 'Zoning' of the Village Code of Mount Prospect, Illinois, which established certain regulations governing the location and establishment of res- idential care homes, including rehabilitation care homes, within the Village of Mount Prospect, Illinois, be repealed?" ECTION TWO: At least fifty-five (55) days prior to the date of the November 2, 1982, General Election, the Village Clerk shall certify to the proper election officials of the County of Cook the above-stated question of public policy to be submitted to the electors of this Village, and shall include with said certification a certified copy of this Ordinance. SECTION THREE: The said General Election of November 2, 1982, and the question of public policy to be submitted to the electors of this Village, as described herein, shall be conducted in the manner prescribed by the Illinois Election Code for preparing and conducting such election. SECTION FOUR: This Ordinance shall be in full force and effect upon its passage, approval, and publication in pamph- let form in accordance with law.
