RDINANCE NO. 3269 AN ORDINANCE TO AMEND CHAPTER 17 ENTITLED "VEHICLE LICENSES" OF THE VILLAGE CODE OF MOUNT PROSPECT, ILLINOIS BY IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE ~ILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: Chapter 17 entitled "Vehicle Licenses" of the Village Cod~ of Mount Prospect, Illinois, 1981, as amended, is hereby further amended as follows: (A) By amending Section 17.102. entitled "Licenses Required" of Article I of Chapter 17 to read as follows: "Sec. 17.102. Licenses Required. Pursuant to the Home Rule provisions contained in Article VII of the Constitution of the State of Illinois of 1970, it is the declared legislative intention that the provisions of this Article I herein control and govern the subject matter of vehicle licenses. No motor vehicle, motor driven cycle, motor bicycle and/or trailer, semi-trailer or other vehicle defined herein, which is owned or operated by a person who resides within the Village or which is owned by a company, firm or corporation which has a place of b~siness located within the Village shall be kept, maintained, stored or used by such person, company, firm, corporation or any representative, agent or employee thereof within the corporate limits of this Village unless the owner of such vehicle secures a license therefor each year and pays into the Village Treasury the license fee as hereinafter provided in this Article. For the purposes of this Section, a vehicle of any such owner herein which shall have attached thereto current motor vehicle license registration plates or stickers issued by the Illinois Secretary of State shall be considered to be 'in use' within the corporate boundaries of this Village°" (B) By amending Section 17~103. entitled "License Fees" of Article I of Chapter 17 to read as follows: "Sec. 17.103. License Fees. Annual license fees for motor vehicles and trailers of various classifications shall be as follows: A. First division vehicles, excluding motorcycles, motor driven cycles and motor bicycles: o Class Type .of Vehicle W Passenger automobiles, including ambulances and hearses. Motorcycles, motor driven cycles and motor bicycles: Class 'M Annual License Fee $ 15.00 12.00 Second division vehicles: I. A self-propelled vehicle operated as a tractor and one semitrailer shall be considered as one vehicle in computing the above license fees, and no additional license fee shall be required for said semitrailer so used. b. The owner of each vehicle who has elected to pa)' a mileage weight tax tolthe State of Illinois Shall be required to be licensed as in this Chapter provided. -2- '7) 2. Trailers. TD 10,001 to 14,000 lbs. 40.00 TF 14,001 to 20,000 lbs. 45.00 TL 20,001 Io 36,000 lbs. 50.00 (C) By amending Section 17.104. entitled "Disposition of Revent to read as follows: "Sec. 17.104. Disposition of Revenues. Ail revenues derived from license and transfer fees shall be used for paying the cost of repair, maintenance and improvement of streets and alleys; traffic law enforcement; automobile emission control testing; and such other uses as the President and Board of Trustees of the Village shall authorize in the annual budget, or shall otherwise direct." (D) By amending Section 17.107. entitled "License Year; Time of Payment - Discount Period." of Article I of Chapter 17 to read as follows: "Sec. 17.107. License Year; Time of Payment'- Late Payment Penalty. Beginning in 1983 and continuing each and every year thereafter, license fees established herein shall be due and payable on or before the first day of May, and licenses issued shall expire on April 30 following the date of issuance. If, after the date license fees become due and payable hereunder, a person acquires a vehicle or becomes a resident of the Village or if a vehicle owned by a person who is a resident of the Village is maintained in storage by virtue of such person's temporary absence from the Village while attending school as a full-time student, or while ful- filling a military obligation on permanent assignment to a military base or station, or for such other reason whereby the vehicle in question is in storage within the Village and is not used on the public streets or highways, then the license fees provided for in Section 17.103. shall be due and pay- able within thirty (30) days after such vehicle is acquired or new residency is established, or such vehicle is removed from storage and placed in use and opera- tion upon the streets and highways of this illage. ;'~ere the said fee becomes due and payable six (6) months or more after the start of the license year, then upon appli- cation being made to the Village Clerk within the thirty (30) day application period, the license shall be issued for the remainder of the year upon payment of one-half (1/2) of the fee provided for in Section 17.103. A. late payment fee of $15.00 shall be payable in addition to the annual license fee pro- vided for in Section 17.103. by all persons who purchase the license after the due date set forth in this Section." (E) By amending Subsection C of Section 17.108. entitled "Plates and Windshield Sticker" of Article I of Chapter 17 to read as follows: "Sec° 17.108. Plates and Windshield Sticker. C. The due date for display of current Village windshield stickers shall be on May 1 of each year." SECTION TWO: The increase in annual license fees provided ~or herein shall take effect and become applicable for the License period commencing on April 30, 1983. SECTION THREE: This Ordinance shall be in full force and ef- fect upon its passage, approval, and publication in pamphlet form in accordance with law.
