BA 38-Z-82 11/11/82 ORDINANCE NO. 3280 AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE VILLAGE OF MOUNT PROSPECT WITH P~ESPECT TO THE ZONING OF CERTAIN PROPERTY IN THE B-4 BUSINESS, RETAIL AND SERVICE DISTRICT WHEREAS, Church's Fried Chicken, Inc. of 1015 East State Parkway, Schaumburg, Illinois, has made application to rezone certain property owned by the Applicant, and commonly known as 1790 West Algonquin Road, in the Village of Mount Prospect, Illinois (hereinafter referred to as the "Subject Property"), from its present zoning classification in the B-3 Business, Retail and Service District to the B-4 Business, Retail and Service District, as provided in Article XXI of Chapter 14 of the Village Code of Mount Prospect; and WHEREAS, the Subject Property is legally described as follows: that part of Lot 2 in Edward Busse's Division of parts of the Southeast quarter of Section 15, and the Northeast quarter of Section 22, Township 41 North, Range 11 East, of the 3rd Principal Meridian, per plat recorded December 17, 1919, as Document No. 6696216; lying West of a line which is 362.98 feet West of and parallel with the East life of said Lot 2, and South of the North line of said Northeast quarter of Section 22, (except that part falling in streets and highways); all in Cook County, Illinois; and WHEREAS, a public hearing was held on said rezoning ap- plicatio~ (designated as Case No. ZBA-38-Z-82) before the Zoning Board of Appeals of the Village of Mount Prospect on October 7, 1982, pursuant to proper publication of due notice thereof in the Mount Prospect Herald on September 20, 1982; and WHEREAs, the Zoning Board of Appeals has recommended to the Board of Trustees of the Village that the requested re- zoning be granted; and WHEREAS, the President and Board of Trustees have con- sidered the requested rezoning application and have reviewed the recommendation of the Zoning Board of Appeals pertaining thereto and have determined that the best interests of the Village of Mount Prospect would be obtained by the adoption of the necessary ordinance to accomplish this rezoning. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: BA 38-Z-82 11/11./82 SECTION ONE: The recitals set forth hereinabove are herein as findings of fact by the President and Board of the Village of Mount Prospect. incorporate~ of Trustees SECTION TWO: The official Zoning Map of the Village Prospect pertaining to Chapter 14 entitled "Zoning" of the Village Code of Mount Prospect, Illinois, as amended, is hereby further amended by reclassifying from the B-3 Business, Retail and Service District to the B-4 Business, Retail and Service District the following described property: that part of Lot 2 in Edward Busse's Division of parts of the Southeast quarter of Section 15, and the Northeast quarter of Section 22, Township 41 North, Range 11 East, of the 3rd Principal Meridian, per plat recorded December 17, 1919, as-Document No. 6696216; lying West of a line which is 362.98 feet West of and parallel with the East line of said Lot 2, and South of the North line of said Northeast quarter of Section 22, (except that part falling in streets and highways); all in Cook County, Illinois~ SECTION THREE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
