BA 39-SU-$2 11/11/82 ORDINANCE NO. 3281 AN ORDINANCE APPROVING AND AUTHORIZING A SPECIAL USE TO ALLOW THE OPERATION ~OF A RESTAURANT WITH A DRIVE-UP WINDOW ON CERTAIN PROPERTY LOCATED IN THE B-4 BUSINESS, RETAIL AND SERVICE DISTRICT, AS ZONED, IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Church's Fried Chicken, Inc., the Petitioner herein, has made application for a special use with respect to certain property zoned and classified in the B-4 Business, Retail and Service District for the purpose of operating and maintaining a Class IV restaurant with a drive-up window, pursuant to the provisions of Section 14.2101.C of Chapter 14 of the Village Code of Mount Prospect, Illinois; and WHEREAS, the Subject Property is located at 1790 West Algonquin Road, Mount Prospect, Illinois, and is legally described as follows: that part of Lot 2 in Edward Busse's Division of parts of the Southeast quarter of Section 15, and the Northeast quarter of Section 22, Township 41 North, Range 11 East, of the 3rd Principal Meridian, per plat recorded December 17, 1919, as Document No. 6696216; lying West of a line which is 362.98 feet West of and parallel with the East line of said Lot 2, and South of the North line of said Northeast quarter of Section 22, (except that part falling in streets and highways); all in Cook County, Illinois; and WHEREAS, a public hearing was held on said Special Use Application (designated as Case No. ZBA-39-SU-82) before the Zoning Board of Appeals of the Village of Mount Prospect on October 7, 1982 pursuant to proper publication of due notice thereof in the Mount Prospect Herald on September 20, 1982; and WHEREAS, the Zoning Board of Appeals has submitted its finding and recommendation to the Village that the special use permit be granted subject to compliance with the condi- tions hereinafter set forth; and WHEREAS, the President and Board of Trustees have con- sidered this Special Use Application and have determined that the Subject Property complies with the standards set forth in Section 14.704 of said Chapter 14 regarding a special use, and that the best interests of the Village of Mount Prospect would be obtained by the adoption of the necessary ordinance to approve and authorize the said special use, subject to compliance with the conditions hereinafter set forth. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: BA 39-SU-82 11/11/82 SECTION ONE: The recitals set forth hereinabove are incorpor- ated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: A special use for the Subject Property, described above, to allow the operation of a Class IV restaurant with a drive-up window within a B-4 Business, Retail and Service District, pursuant to Section 14.2101.C.2 of said Chapter 14 is hereby approved subject to compliance with the following conditions: 1. Handicapped ramp shall be added at all locations where sidewalks meet curbs. 2. There shall be no left turn from the site onto Dempster Street. The proposed lighting on the site shall be re- located for better illumination at entrances and Parkway trees shall be planted; said lighting relocation and tree planting accomplished to the satisfaction of the Village .administrative staff. The interior design shall be modified to provide for a curbing adjacent to the first parking space along Algonquin Road so as to channel traffic from Algonquin into the main parking area while protecting the lighting structures and the parking spaces. 5. This area shall also be landscaped to meet the Village administrative approval. In all other respects, the Subject Property shall be developed in accordance with the three-page Preliminary Development Plan, dated August 20, 1982, prepared by Continental Engineers & Associates SECTION THREE: This Ordinance shall be in full force and effect upon its passage, approval and publication in pamphlet form in the manner provided by law.
