MINUTES COMMITTEE OF THE WHOLE MARCH 25, 2003 CALL TO ORDER The meebng was called to order at 7:05 p.m by Mayor Gerald Farley, in the Mt Prospect Park District Community Center, 1000 West Central Road. Present at the meeting were' Trustees R~chard Lohrstorfer, Michaele Skowron, Irvana W~lks and M~chael Zadel. Absent from the meebng were: Trustees T~mothy Corcoran and Paul Hoefert. Staff members present included' V~llage Manager M~chael Janoms, Assistant Vdlage Manager David Strahl, Commumty Development D~rector W~lham Cooney, Streets and Buildings Supervisor Paul Bures, V~llage Attorneys Everette H~ll, George Wagner, Kathy Henn and Lance Malina, V~llage Engineer Jeff Wulbecker and Sohd Waste Coordinator Lisa Angell. APPROVAL OF MINUTES Approval of minutes from March 11, 2003 Mobon was made by Trustee Zadel and Seconded by Trustee Lohrstorfer. Trustee W~lks pointed out there was a need to ensure there were higher fees charged if compi~ance was not forthcoming as reflected in the consensus. M~nutes were approved CITIZENS TO BE HEARD None. OVERVIEW OF CONFLICT OF INTEREST~ OPEN MEETINGS ACT AND FREEDOM OF INFORMATION ACT Village Attorney Everette Hill provided an introducbon to the legal team members and each area of concentrabon that they will be focusing on Attorney Kathy Henn discussed e-ma,l communications relabng to Freedom of Informabon and pubhc records. She provided a defimt~on of pubhc records and whether e-ma~l ~s a pubhc record depends on who prepares the document and whose control ~t remains under. She stated that there are monitonng systems available for employee e- mail which many employers have put ~n place. She stated there is no requirement to d~sclose GIS maps if available and generally, she stated that if a document can found, it should be considered in the public domain. There was a general d~scuss~on ,regarding general conversabons between Board members via e-ma~l. It was pointed out that the Board members should be careful not to engage ~n extension d,scuss~on via e-ma~l since ~t could logically be considered a pubhc meeting which would create additional issues I. VII. Attorney Lance Malina prowded mformabon on the Freedom of Information and Open Meetings Act He provided a summary of pending legislation currently before the General Assembly. He provided the deflnibon of a pubhc meebng and exceptions that allow a pubhc body to go into Closed Session. He also d~scussed the topics that are hm~ted to be placed on the Agenda as part of a pubhc meeting. He d~scussed procedural detads of calling a Closed Session and the necessary detail to provide notice He prowded information regarding the hm~t of lit~gabon regarding open meetings and possible exposure to elected and appointed staff officials. He stated the m~nutes only need to be a summary of the Closed Session and a semi-annual review and release of m~nutes from Closed Session is required. He stated that communicating wa e-mail through a reply by all could potenbally be considered a pubhc meebng and should assume that e-mail be conmdered pubhc informabon He suggested that the d~scusmons could take place by responding d~rectly back to the Vdlage Manager and the Manager consolidate those suggestions and return them back to the Board members for their information. He also stated that items can be added to the Agenda at a meeting, however, those items cannot be for final action Attorneys Buzz Hill, George Wagner and Lance Malina d~scussed various scenarios for illustrative purposes and varying fact patterns to describe possible conflict of interest, and provide adwce on addressing these posmble conflicts. VILLAGE MANAGER'S REPORT None. ANY OTHER BUSINESS Trustee Skowron wanted to invite all the residents to the recently relocated Representative Carolyn Krause's new office at 200 East Evergreen. The Open House is on March 29, from 9 30 a.m unb111:30 a m. ADJOURNMENT There being no fudher business, the meeting adjourned at 9.40 p m.
