AN ORDINANCE AMENDING CERTAIN USE PROVISIONS
WITH RESPECT TO THE.I-1 LIGHT INDUSTRIAL
DISTRICT OF CHAPTER 14 ENTITLED "ZONING" OF
THE VILI~AGE'CODE OF MOUNT PROSPECT, ILLINOIS
WHEREAS, pursuant to an Annexation Agreement, the Central
National Bank of Chicago, as trustee under a Trust Agreement
dated May 18, 1977, and known as Trust No. 22461, and Arrow
Road Construction Company, the beneficiary of said Trust,
have submitted an application for a text amendment to the
use provisions in an I-1 Light Industrial District as pro-
vided in Article XXII of Chapter 14 of the Village Code of
Mount Prospect, Illinois; and
~EREAS, said text amendment is for the purpose~of
allowing certain property owned.by and beneficially owned
by the Applicants to be used for Asphalt manufacture, and
refining when part of a planned unit development; and
WHEREAS, a public hearing was held on said zoning text
amendment Application (designated as Case No. ZBA-31-A-82)
before the Zoning Board of Appeals of the Village of Mount
Prospect on the second day of September, 1982, pursuant to
proper publication of due notice thereof in the Mount Prospect
Herald, on August 16, 1982; and
WHEREAS, the Zoning Board ~., Appeals has forwarded its
finding and recommendation to the ~oard of Trustees of the
Village that the requested text amendment be approved to
provide that the'Asphalt manufacture and refining use be
allowed as a special Us~ where already in existence and when
~art of a planned development; and
WHEREAS, it is deemed to be in the best interests of the
'illage of MoUnt Prospect that said text amendment be adopted.
NOW, THERE,'ORE, BE IT ORDAINED B~ THE PRESIDENT AND BOARD
OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY,
ILLINOIS:
SECTION ONE: Section 14.2201 entitled "Permitted Uses" of
Article XXII, Chapter 14, of the Village Code of Mount Prospect,
Illinois, 1981, is hereby amended as follows:
(A) By retitling Section 14.2201 to read "Permitted Uses
and 'Special Uses."
(B) By amending paragraph 9 of Subsection B of said
Section 14.2201 to read:
"9. Asphalt' manUfacture or refining when not part
of a planned unit development."
(C) By adding a new Subsection C to said Section 14.2201
to read:
In the I-1 Light Industrial District, the
'following uses may be allowed by Special Use
permit in acc6rdance with Article VII of this
Chapter.

:ECTION TWO: This Ordinance shall be in full force and effect
upon its passage, approval and~b'ilc~i6n~in '~phl~-fOrm
in accordance with law.
