ZBA 33-V-82 '11/11/82 ORDINANCE NO. 3290 AN ORDINANCE GRANTING SPECIFIED VARIATIONS FOR PROPERTY COMMONLY KNOWN AS THE ARROW ROAD CONSTRUCTION COMPANY PROPERTY IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, pursuant to an Annexation Agreement, the Central National Bank and Trust Company, as trustee under a Trust Agreement dated May 18, 1977, and known as Trust No. 22461, and Arrow Road Construction Company, sole beneficiary under said Trust, the owner and beneficial owner, respectively, of certain property hereinafter described, located at 3401 South Busse Road, in the Village of Mount Prospect, Illinois, have filed an application seeking variations from certain regula- tions contained in Article XXII of Chapter 14 of the Village Code of Mount Prospect, Illinois; and WHEREAs, the subject property is described as follows: That part o~ the SoUthwest 1/4 of Section 23r Tovrnship 41 Norl~ Range 11 East of.the Third ~rincipal Meridia~ described.as ~oll°~s: Commenclng at a point on the West line of Sec%mon 23 in samd ToWnship and Range, that is 1242.6 feet. North of.the Sou~west corner thereof; thence North along samd West lmne of Sectmon 23, 228.1 feet; thence East alon~ a line that is 1470.7 feet North of and parallel with the Sout~ line qf said Section 23, a distance of 586.91 feet~'~then~e South on a ~ine that is 2051.50 feet West of and paral~e~ w~th the East lane of said SouthweSt 1/4 a distance of 800 f~et; thence West on a line that ms 670.7 feet North of and parallel with said South l~neI o Section 23, a distance of ~4.55 feet; thence ~orthwesterly 791.6 feet alOng a llne whmch makes a left deflection of 133 degrees 45 minutes 00 seconds with the last described course the point of beginning, all in Cook County, Illinois, and lying West of a line parallel with and distant 76 feet East West line of Section 23, all in Cook County, Illinois. and WHEREAS, the subject property was recently annexed to the Village of Mount Prospect and was thereafter zoned and classifie~ in the I-1 Light Industrial District, and granted a Special Use and planned unit development approval to allow the continuation of an existing asphalt manufacture or refining operation on the subject property from the existing buildings, structures and other areas where such operation is presently being conducted; and ~ WHEREAS, Applicants seek variations hereinafter Set forth from the regulations contained in Article XXII of Chapter 14, of the said Village Code to bring such existing operations into conformity with Village requirements; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA-33-V-82) before the Zoning Board of Appeals of the Village of Mount Prospect, Illinois, on the second day of September, 1982, pursuant to due and proper notice thereof published in the Mount Prospect Herald on August 16, 1982; and ZBA ll/ll/82 WHEREAS, the Zoning Board of Appeals has recommended that the President and Board of Trustees of the Village of Mount Prospect grant the requested variations, as hereinafter set forth; and WHEREAS, the President and Board of Trustees of ~hq~illage of Mount Prospect have determined that the requested variations satisfy the standards set forth in Section 14.605 of Article VI of Chapter 14, and further find that it would be in the best interests of the Village to grant to Applicants the requested variations. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, cOOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporate herein as findings of fact by the President and Board of Trustee of the Village of Mount Prospect, Illinois. SECTION TWO: The President and Board of Trustees do hereby de- termine the structures and uses currently existing upon the subject property are in conformance with the Village Ordinance requirements and Zoning Regulations, and to obtain such con- formity the following variations of Article ~XII_ of Chapter ~14 are hereby granted: I Section 14.2202.B. Varlat~on to permit truck scale platform !and curbing to ~emain within 21 + feet of the side lot line I1 an4 to permit gasoline pumps and concrete ~ad to remain w{~hin 7 + feet of the Side 10t line instead of the 30 foot. mi~Lmum side yard setback. Section 14.2202.C. Variation to permit storage tank area to ex~$t within 7~ + feet of rear lot line and to permit frame ga~Bge to exist-within 6.44 feet of the rear lot line inmhead'of the 20 foot minimum rear yard. Secbion 14.2203.B. Variation from ~he 80% maximum ground a~ga coverage to permit increased storage of material. ~Section 14.2204.A.2. Va.rlation from the 20 foot maximum height of goods stored ~n the open. Section 14.2205.A.1. Variation from 1 off-street parking space for each 200 square feet to 1 off-sbreet parking space for each 300 square feet. Section 14.2205.A.2. Variation to eliminate the ~off-s. treet parking requirements for the lot area used for storage. Section 14.2205.D & F. Variation to eliminate provisions of these Sections relating to parking in the industrial rear yards. Section 14.2503.A.8. Variation to eliminate the 10% increase in off-street parking'and loading requirements. -2- BA 33-V-82 11/11/82 S_ECT.ION THREE: Except for the variations granted herein, all other applicable Village of Mount Prospect Ordinances and reg- ulations shall remain in full force and effect as to the subject property.
