ORDINAI~CE NO. 3330 AN ORDINANCE GRANTING SPECIFIED VARIATIONS FOR PROPERTY COMMONLY KNOWN AS THE WINONA SCHOOL OF PROFESSIONAL PHOTOGRAPHY AT 350 NORTH WOLF ROAD, IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Winona School of Professional Photography, the owners of certain property hereinafter described, pre- viouSlY known as the Shadrach Bond School property, and located at 350 North Wolf Road in the Village of Mount Prospect, Illinois, has filed an application seeking various variations from certain provisions of Article XVIII of Chapter 14 of the Village Code of Mount Prospect, Illinois has hereinafter set forth; and WHEREAS, the Subject Property is described as follows: That part of the North East Quarter (1/4) of Section 35, Township 42 North, Range 11, East of the Third Principal Meridian, described as follows: Beginning at a point on the South line of said North East Quarter (1/4) which is a distance of 250 feet West of the South East corner of said North East Quarter (1/4); thence West along the South line of said North East Quarter (1/4) a distance of 280 feet; thence North along a line drawn parallel with the East line of said North East Quarter (1/4) a distance of 820 feet; thence East along a line drawn parallel with the South line of said North East Quarter (1/4) a distance of 480 feet to the West line of Wolf Road; thence South along the West line of Wolf Road, said line being 50 feet West of and parallel with the East line of said North East Quarter (1/4) a distance of 612 feet; thence West along a line drawn parallel with the South line of said North East Quarter (1/4) a distance of 200 feet; thence South along a line drawn parallel with the East line of said North East Quarter (1/4) a distance of 208 feet to the place of beginning: Acreage 8.08. WHEF~AS, Petitioner seeks the following specific variations, to-wit: A variation from Section 14.1805.A. to allow one parking space for every three hundred fifty (350) sq. ft. of gross floor area used in the subject building to be used for private school purposes. A variation from Section 14.1805.B.2 to provide for only one off-street loading space for the subject building having approximately 25,640 sq. ft. of floor area ~ather than the required two loading spaces for such building. WHEREAS, a Public Hearing was held on Petitioner's re- quest for the subject variations (designated as Case No. ZBA- 11-V-83) before the Zoning Board of Appeals of the Village of Mount Prospect on the 24th day of March, 1983 pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 7th day of March , 1983; and ~EREAS, the Zoning Board of Appeals has submitted its findings and recommendations that the request of variations be given; and WHEREAS, the President and Board of Trustees of the Village have considered further the variation requests and have determined that the same satisfies the standards set forth in Section 14.~05 of Article VI of Chapter 14 of the Village Code and further find that it would be in the best interest of the Village to grant the variations hereinafter set forth. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recital set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect, Illinois. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect do hereby grant to the Subject Property the variations requested from Section 14.1805.A and B.2 of Chapter 14 of the Village Code of Mount Prospect, Illinois, in order to allow Petitioner to provide one off-street parking space for every three hundred fifty (350) sq. ft. of gross floor area used in the building located on said premises and to provide one off-street loading, space. SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect ordinances and regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and Pub- lication in pamphlet form in the manner provided by law.
