RDINANCE NO. 3333 AN ORDINANCE GRANTING SPECIFIED VARIATIONS FOR PROPERTY CO~ONLY KNOI%~] AS THE HILL STREET SUBDIVISION LOCATED ON HILL STREET IN THE VILLAGE OF MOUNT PP~SPECT, ILLINOIS ~EREAS, the beneficial owners of a certain residential subdivision hereinafter described, on Hill Street in the Village of Mount Prospect, Illinois and commonly kno~ as the "Hill Street Subdivision" filed an application seeking a variation from Section 14.1101.A.1 of Article XI of Chapter 14 of the Village Code of Mount Prospect, Illinois regarding lot widths, for the purpose of allowing a re- subdivision of certain lots in said Subdivision; and ~EREAS, the Subject Property as resubdivided is des- cribed as follows: Lots 11 through 20 in the resubdivision of 'Lots 11 through 18 of the Hill Street Subdivision, a Subdivision of the East four hundred (400) feet of that part of the North half of the South- east quarter of the Northeast quarter of SeCtion 34, Township 42 North, Range 11, East of the Third Principal Meridian, lying East of Rand Road, in Cook County, Illinois. WHEREAS, Petitioners seek a variation from the lot width requirements of said Section 14.1101.A.1 to provide for lot widths of less than sixty-five (65) feet on the resubdivided Lots 11 through 17 and Lots 19 and 20; and a lot width of less than seventy-five (75) feet on corner Lot 18, all as set forth on the resubdivision plat (a copy of which is attached hereto and made a part of this Ordinance by reference); and WHEREAS, a Public Hearing was held on Petitioners request for the aforesaid variation (designated as Case Number ZBA-2-V-83) before the Zoning Board of Appeals of the Village of Mount Prospect on the 24th day of February, 1983, pursuant to due and proper notice there- of published in the Mount Prospect Herald on February 8, 1983; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations that said variance be permitted for all of Lots 11 through 20 (including therein Lots 11 and 12 which exceed the lot width standard by twenty-five (25%) percent); and WHEREAS, the President and Board of Trustees of the Village have considered further the variation request and have determined that the same satisfies the standards set forth in Section 14.605 of Article VI of Chapter 14 of the Village Code, including the variation of lot width for Lots 1t and 12, and further find that it would be in the best interests of the Village to grant the variation hereinafter set forth. NOW, THEREFORE, BE IT ORDAINED BY THE PP~SIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect, Illinois. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect do hereby grant to the subject property a variation ~rom Section 14.1101.A.1 .with respect to Lots 11 and 12 in order to allow the resubdivision of Lots 11 through 18 of the Hill Street Subdivision to provide for newly resubdivided Lots 11 through 20 having reduced lot widths as set forth on the attached plat. SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: This Ordinance shall be in full force and ~ffect ~rom and after its passage, approval and publication in pamphlet form in the manner provided by law.
