HomeMy WebLinkAboutOrd 3380 11/01/1983ORDINANCE NO. 3380 AN ORDINANCE APPROVING AND AUTHORIZING A SPECIAL USE TO ALLOW AN AUTOMOBILE MAINTENANCE AND SERVICE CENTER BY BUTLER WALKER INCORPORATED, ON A PORTION OF PROPERTY COMMONLY KNOWN AS THE MOUNT PROSPECT PLAZA IN THE VILLAGE OF MOUNT PROSPECT~ ILLINOIS WHEREAS, BBtler Walker Incorporated, the Petitioner herein, ~s made application for a special use with respect to a portion certain property located at 950 East Rand Road in the Village Mount Prospect, Illinois, commonly known as the Mount Prospect aza, to authorize the use of said property for establishing and ~intaining an automobile maintenance and service-.center specializ~ n quick automobile oil and lubrication services, within the B-3 usiness, Retail and Service District, pursuant to the provisions f Section 14.2001.C.5 of Article XX of Chapter 14 of the Village Dde of Mount Prospect, Illinois; and WHEREAS, the Subject Property is legally described as 91lows: Lot 1 in Plaza Subdivision, being a Subdivision of the Southwest Quarter of Section 35, Township 42 North, Range 1t East of the Third Principal Meridian, according to the Plat thereof, recorded July 16, 1979, as Document No. 3104778 (except that part thereof falling within Lots 1, 2 and 3 in Centennial Subdivision, being a resubdivision of part of the East half of said Southwest Quarter according to the Plat thereof recorded February 11, 1981 as Document No. 3202476) in Cook County, Illinois; and WHEREAS,'Public Hearings were held on said special use pplication (designated as Case No. ZBA-41-SU-83) before the oning Board of Appeals of~the Village of Mount Prospect, the 22nd day of September, 1983 pursuant to proper publication due notice thereof in the Mount Prospect Herald on the 6th y of September, 1983; and WHEREAS, the Zoning Board of Appeals has submitted its indings and recormmendation to the Village in favor of said pecial use request subject to the inclusion of certain mprovements to be made on the leased site to buffer the parking rea to the North of the existing building on the site and the hree parking areas t~the S~uth~end Of'~the leasehold lying adjacel o the existing building as recommended by the Community Develop- ent Department of the Village; and WHEREAS, the President and Board of Trustees have considered he special use application and have determined that the subject roperty complies with the standards set forth in Section 14.704 o~ rticle VII of said Chapter 14 regarding the special use, and that he best interests of the Village of Mount Prospect will be obtain~ y the adoption of the necessary ordinance to approve and authoriz~ he said special use subject to compliance with the landscaping mprovements recommended by the Community Development Department. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF RUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recital set forth hereinabove are incorporate. ~rein as findings of fact by the President and Board of Trustees the Village of Mount Prospect. SECTION TWO: A Special Use for the Subject Property described rein, to allow the operation and maintenance of an Automobile intenance and Service Center within the B-3 Business, Retail and S ~rvice District pursuant to Section 14.2001.C.5 of Article XX of s .id Chapter~14 is hereby approved, subject to compliance by the P ~titioner with landscaping and buffering improvements along the p~rking areas both North and South of the leasehold property as approved by the Community Development Department of the Village. SECTION THREE: This Ordinance shall be in full force and effec f om and after its passage, approval and publication in pamphlet f .rm in a manner provided by law. P.
