ORDINANCE NO. 3425 AN ORDINANCE TO ADD A NEW SECTION 23.604 ENTITLED "TRUANCY PROHIBITED" TO CHAPTER 23, ARTICLE VI OF THE VILLAGE CODE OF MOUNT PROSPECT, ILLINOIS BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF HE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLIN~~. SECTION ONE: The President and Board of Trustees of this illage does hereby find as follows: 1. That there is a growing problem of chronic absenteeism rom school.by students under the age of eighteen (18), par- icularly those between the ages of sixteen (16) and eighteen ~8) who are enrolled in the high schools of this community. 2. That in many instances police records show that ~rsons under the age of eighteen (18) who have been involved committing offenses of vandalism, drug abuse, alcoholic )nsumption, and disorderly conduct within this community, ~ve also been guilty of truancy in violation of State laws ~garding compulsory school attendance or parental education 2rections. 3. That current procedures provided in the Illinois ihool Code and the Juvenile Court Act for handling problems truancy are time consuming, expensive in terms of both rsonnel and expenditures of time and effort on the part of ~hool district administrators, and, for the most part, have ~oved ineffective in combating such absenteeism from school. 4. That it is in the best interests of this ~community ld for the public welfare of the citizens and residents of )unt Prospect that minor persons under the age of eighteen [8), when enrolled in school pursuant to the directions of ~rents, guardians or those having custody of said minor ~rson, or pursuant to the compulsory school attendance re- lirements of the State of Illinois, shall not absent them- ~lves from school attendance without parental permission or 2her valid cause. 5. That establishing the offense of truancy, and sub- ~cting persons under eighteen (18) to a fine for a violation ~ereof, is deemed to be a reasonable exercise, by the Village, ~ its powers to regulate areas of public health, safety, morals, ~d welfare for the benefit of the community. SECTION TWO: Chapter 23, Article VI entitled "Minors" therefore, hereby amended to add thereto a new Section 23.6~ be entitled "Truancy Prohibited" and to read as follows: "Sec. 23.604. Truancy Prohibited It shall be unlawful for any person under the age of eighteen (18) enrolled in a public, private or parochial school within the corporate limits of the Village of Mount Prospect, Illinois, to absent himself or herself from attendance at school, during such period when school is in session, without parental permission or valid cause. Be A valid cause for absence from school shall include illness, death in the immediate family, other family emergency, or other causes beyond the control of the erson so absenting himself or herself from school, provided that parental permission for absence due to such cause is obtained, in writing, from the parent and is submitted to the proper school authorities within twenty-four (24) hours after such absence. Parental permission aS required by this Section, shall refer to and include permission obtained from a parent, legal guardian, or other adult person standing in local parentis and having custody and control over a person under the age of eighteen (18). Any person who shall so absent himself or herself from school attendance without parental persmission, is provided herein, shall be guilty of the offense of truancy, and upon conviction, shall be subject to a fine of not less than twenty five ($25.00) dollars nor more than one hundred ($100.00) dollars for each offense, and each day that such person so absents himself from school attendance shall constitute a separate offense, and shall be punishable as such." SECTION THREE: This Ordinance shall be in full force and el mct upon its passage, approval and publication in pamphlet fo in accordance with law. PA ED and APPROVED this 5th day of AY~."
