HomeMy WebLinkAboutOrd 3444 08/21/1984ORDINANCE NO. 3444 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 2832 BRIARWOOD DRIVE EAST IN THE VILLAGE OF MOUNT PROSPECT~ ILLINOIS PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES THE 21st DAY OF August, 1984 Published in pamphlet form by authority of the cqrporate~ . authorities of the village of Mount Prospect, Illinois the 21st day of Au~ust~ 1984 02V oRDINANCE NO. 3444 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 2832 BRIARWOOD DRIVE EAST IN THE VILLAGE OF MOUNT PROSPECT~ ILLINOIS WHEREAS, Arlene and Gerald Lukas have filed an apPlication for riations with respect to their residence property commonly .known 2832 Briarwood Drive East in the Village of blount Prospect, linois (the "Subject Property"); and WHEREAS, the Subject Property is desCribed as follows: Lot 1, Lucas Resubdivision of part of Lots 54 and 55 in Lake Briarwood, a Subdivision of part of the West Half of the East Half of Section 22, Township 41 North, Range 11 East of the Third Principal Meridian in Cook County, Illinois. WHEREAS, Petitioners seek the following variations from ovisions of Chapter 14 of the Village Code of Mount Prospect, tlinois, to allow the construction of a 28 foot'wide driveway tther than the 18 foot driveway required by Section 14.116.C of tticle I, and to construct a three-car garage rather than a two-cal ~rage as required by Section 14.1101.B.3 of Article XI; and WHEREAS, a public hearing was held on the variation requests ]esignated as Case No. ZBA-29-V-84) before the Zoning Board of )peals of the Village of Mount Prospect on the 26th day of July, 1)84, pursuant to due and proper notice thereof published in the M)unt Prospect Herald on the 9th day of July, 1984; and WHEREAS, the Zoning Board of APpeals has submitted its findings aid recommendations to the President and Board of Trustees of the V Lllage of Mount Prospect to allow the requested variations subjeCt t) a driveway taper of 18 feet at the curb and the President and B )ard of Trustees of said Village have given fUrther consideration ) the variation requests and have determined that the same satisfy ]e standards set forth in Section 14.605 of Article VI of Chapter of the Village Code, and this Board further finds that it would in the best interest of the Village to grant the request for riations, without the suggested driveway taper. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF ISTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, )LLOWS: SECTION ONE: The recitals set forth hereinabove are ~corporated herein as findings of fact by the President and Board Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Villag, Mount Prospect hereby grant to the Subject Property the riations requested with respect to Sections 14.116.C of Article I ~d 14.1101.B.3 of Article XI of the Village Code of Mount Prospect Llinois, to allow a driveway of 28 feet in width without a taper, id the construction of a three-car garage on the Subject property. SECTION THREE: Except for the variations granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: from and after its form in the manner This Ordinance shall be in full force and effect passage· approval and publication in pamphlet provided by law.
