RDINANCE NO. 3470
AN ORDINANCE AMENDING CERTAIN SPECIAL USE
PROVISIONS WITH RESPECT TO THE I-1 LIGHT
INDUSTRIAL DISTRICT OF CHA~TER 14 ENTITLED
"ZONING" OF THE VILLAGE CODE OF MOUNT
PROSPECT, ILLINOIS
WHEREAS, pursuant to an Annexation Agreement, the First
National Bank of Des Plaines, as trustee under a trust agreement
dated June 27, 1980, and known as trust Not 98142999, and
Arc Disposal Company, the beneficiary of said Trust have
submitted an application for a text amendment to the special
use provisions in an I-1 Light Industrial District as provided
in Article XX!I cf Chapter 14 of the Village Code of Mount
Prospect, Illinois; and
WHEREAS, said text amendment is for the purpose of allowing
certain property owned by the applicants to be used as a transfer
station for refuse disposal; and
WHEREAS, a public hearing was h~ld on said zoning text
amendment application (designated as case No. ZBA-36-A-84)
before the Zoning Board of Appeals of the Village of Mount
Prospect on the 23rd day of August, 1984 pursuant to proper
publication of due notice thereof in the Mount Prospect
Herald, on the 6th day of August , 1984; and
WHEREAS, the Zoning Board of Appeals has forwarded its
finding and recommendation to the Board of Trustees of the
Village that the requested text amendment be denied, but that
the requested special use in the zoning district designated be
allowed; which two recommendations cannot exist separate from
each other; and
WHEREAS, the President and Board of Trustees have given
further consideration to the subject request and deem it to
be in the best interest of the Village of Mount Prospect that
said text amendment be adopted.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD
OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY,
ILLINOIS:
SECTION 1: Section 14.2201.C pertaining to special
uses permitted in an I-1 Light Industrial District, of
Article XXII, Chapter 14 of the Village Code of Mount Prospect,
Illinois, 1981, is hereby amended by adding thereto a
new paragraph ~ to read as follows:
'~.Transfer Stations for Refuse Disposal."
SECTION 2: This Ordinance shall be in full force and
effect upon its passage, approval and publication in pamphlet
form in accordance with law.
