HomeMy WebLinkAboutOrd 3473 11/20/1984 RDINANCE N0.3473 AN ORDINANCE GRANTING VARIATIONS FOR CERTAIN PROPERTY COMMONLY KNOWN AS THE ARC DISPOSAL COMPANY PROPERTY IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES THE 20 DAY OF Novembe~ 1984 Published in pamphlet form by authority of the corporate authorities of the Village of Mount Prospect, Illinois 21 day of Novmeber , 1984. 009V ORDINANCE NO. 3473 AN ORDINANCE GRANTING VARIATIONS FOR CERTAIN PROPERTY COMMONLY KNOWN AS THE ARC DISPOSAL COMPANY PROPERTY IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Arc Disposal Company has filed an application for variations with respect to property commonly known as 2101 South Busse Road in the Village of Mount Prospect, Illinois (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: The West 1134.83 feet as measured on the North and South Lines thereof, of the South 164.88 feet, as measured on the East and West lines thereof, of the West Half (1/2) of the Northwest Quarter (1/4) of Section 23, Township 41 North, Range 11 East of the Third Principal Meridian, excepting therefrom all that part thereof heretofore used, taken or dedicated for public roads and streets, in Cook County, Illinois; and WHEREAS, Petitioner seeks the following variations from provisions of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the continuation of an existing transfer station for refuse disposal purposes presently located on the Subject Property, recently annexed to the Village, to wit: A variation of the provisions of Section 14.2202 of Article XXII to provide for a side yard of fifteen (15') feet on the North and of zero (0') feet on the South rather than the required thirty (30') side yard; and to allow a rear yard of zero (0') feet rather than the required twenty (20') foot rear yard. A variation of the provisions of Section 14.2203 of Article XXII to allow a lot containing 3.3 acres rather than the required minimum of 4 acres and to allow the intensity of use of the ground area of said lot to exceed the maximum eighty percent (80%) required. A variation of the provisions of Section 14.2204 of Article XXII to allow a building on the Subject Property having a height of forty-five (45') feet rather than the required maximum height of thirty (30') feet. De A variation of the provisions of Section 14.2205 of Article XXII to permit fifty-six (56) off-street parking spaces rather than the required one hundred fifty-eight (158) spaces and to further eliminate the required truckloading spaces. WHEREAS, a public hearing was held on the variation requests (designated as Case No. ZBA-39-V-84) before the Zoning Board of Appeals of the Village of Mount Prospect on the 23rd day of August, 1984, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 6th day of August, 1984; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations to the President and Board of Trustees of the Village of Mount Prospect to allow the requested variations, and the President and Board of Trustees of said Village have given further consideration to the variation requests and have determined that the same satisfy the standards set forth in Section 14.605 of Article VI P"~'~-V-84 2 of 2 of Chapter 14 of the Village Code, and further find that it would be in the best interest of the Village to grant the request for variations, provided that the Petitioner fulfills all of the requirements of the Development Code pertaining to sidewalks, screening and landscaping of the Subject Property, as approved by the Community Development Department of the Village. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the variations requested with respect to Sections 14.2202, 14.2203, 14.2204 and 14.2205 of Chapter 14 of the Village Code of Mount Prospect, Illinois, to vary the side yards, rear yard, intensity of lot use, building height and required parking and truckloading spaces as set forth in said sections, provided that Petitioner complies with all of the requirements of the Development Code of this Village with respect to sidewalks, screening and landscaping as approved by the Community Development Department of this Village. SECTION THREE: Except for the variations granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: That the variations granted herein are subject to the petitioner completing the landscaping and site improvements pursuant to the landscape and site plans as approved the Department of Community Development. SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
