WI~EREAS, Petitioner seeks the following variation from ~ovislons of Chapter 14 of the Village Code of Mount Prospect, llinois, to allow the encroachment of a patio along the east side the residence property to occupy all but one foot of the required .6 foot side yard provided by Section 14.1102 of Article XI o~ said ~apter 14; and WHEREAS, a public hearing was held on the variation request ~esignated as Case No. ZBA-45-V-84) before the Zoning Board of ~peals of the Village of Mount Prospect on the 15tn day of ~vember, 1984, pursuant to due and proper notice thereof published the Mount Prospect Herald on the 8th day of OctoOer, 1984; and WHEREAS, the Zoning Board of Appeals has submitted its finGings recommendation to the President and Board of Trustees of the [llage of Mount Prospect to deny the requested Variation, and the ~esident and Board of Trustees of said village have given furtheI Dnsideration to the variation request and have determined that th9 ~me satisfies the standards set forth in Section 14.605 of Articl~ of Chapter 14 of the village Code, and th~s Board further finds~ ~at it would be in the best interest of the Village to grant the ~quest for variation. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF ~ RUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, ~S )LLows: ~ SECTION ONE: The recitals set forth hereinaD°ve are ~ nco~rein as findings of fact by the President and Board] Trustees of the Village of Mount Prospect. ~ SECTION TWO:' The President and Board of Trustees of the Village M~ct hereby grant to the Subject Property the variatiqn quested with respect to Section 14.1102 of Article XI of Chapter! of the Village Code of Mount Prospect, Illinois, to allow a patio encroach upon and occupy all but one foot of the required 8.6 ~ ot side yard, in accordance with the site plan attached hereto.
