AN ORDINANCE AMENDING THE ~499 ZONING ORDINANCE OF THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WITH RESPECT TO ZONING CERTAIN PROPERTY IN THE B-4 BUSINESS, RETAIL AND SERVICE DISTRICT HEREAS, Precision Automotive Sales & Service, Inc. of 200 South Will am Street, Mount Prospect, Illinois has Petitioned to rezone cert~ in Property hereinafter described from the B-3 Business, Retail and ervice District to the B-4 Business, Retail and Service District for he purpose of permitting the establishment and operation of an auto obile sales, service and minimal garage operation (excluding body fender and painting operations); said property being legally desc]ibed as follows: Lots 53 through 58, both inclusive (except 3' 1 1/2" taken evenly off the Easterly side of said Lot 58), in Morningside Gardens, being a Subdivision of part of the Northeast quarter of Section 12, Township 41 North, Range 11, East of the Third Principal Meridian, in Cook C.punty, Illinois. I IEREAS, a public hearing was held on said rezoning application (des )nated as Case No. ZBA-6-Z-85) before the Zoning Board of Appe~ .s of the Village of Mount Prospect on the 24th d~y of January, 1985 pursuant to proper publication of due notice in the Mount Pros ~ct Herald on the 8th day of January, 1985; and {EREAS, the Zoning Board of Appeals has forwarded its finding and ~commendation to the Board of Trustees of the Village that the requ ~ted rezoning be approved, subject to implementation by the Petit .oner, of landscaping and other improvements as aPproved by the Comm~ ~ity Development Department, and the President and Board of Trust ~es have considered further the finding and recommendation of the )ning Board of Appeals and Petitioner's request, and have dete lined that the best interest of the Village of Mount Prospect woul~ be obtained by the adoption of the necessary ordinance to accor )tish said rezoning. ~ )W THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUS. ~ES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: ~ ~CTION ONE: The recitals set forth hereinabove are incorporated here! !1 as findings of fact by the President and Board of Trustees of the V~llage of Mount Prospect. ~CTION TWO: The Zoning Ordinance (Chapter 14 entitled "Zoning" of t~ Village Code of Mount Prospect, Illinois, as amended) is here,S further amended to rezone and reclassify from the B-3 Business, Retail and Service District to t~e B-4, Business, Retail and ~rvice District, the following descrioed property: Lots 53 through 58, both inclusive, (except 3' 1 1/2" taken evenly off the Easterly side of said Lot 58), in Morningside Gardens, being a Subdivision of part of the Northeast quarter of Section 12, Township 41 North, Range 1t, East of the Third Principal Meridian, in Cook County, Illinois. age 2 of 2 ~ ~/5/85~ SECTION THREE: Said rezoning of the Subject Property shall be conditioned upon accomplishment of: the recordation of a plat of subdivision placing the subject property into one lot of record; the landscaping and other improvements as approved by the Community Development Department; and on the operation and maintenance of the Subject Property for automotive sales, services and minor garage operations (excluding body, fender and painting operations). SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
