Cha req eli~ (del App~ 198~ Mou inc] rec¢ Plat DevE and inst fol] wi ti and Vil[ Pres cons same of C it w for impr TRUS FOLLi here the WHEREAS, the Subject Property is described as follows: Lots 53 through 58, both inclusive (except 3'1 1/2" taken evenly off the Easterly side of said Lot 58) in Morningside Gardens, being a Subdivision of part of the Northeast quarter of Section 12, Township 41 North, Range 11, East of the third Principal Meridian in Cook County, Illinois. WHEREAS, the Petitioner seeks the following variation from isions of Chapter 14 of the Village Code of Mount Prospect, nois, to vary the minimum rear yard requirements and the street parking and loading requirements contained in Section 102.C and 14.2105.B.1 respectively of Article XXI, of said ter 14 to allow an access drive-way to continue across the ired rear yard to serve properties to the East thereof, and to inate a required truck loading area on Petitioner's property; a]~d WHEREAS, a public hearing was held on the variation request ignated as Case No. ZBA-7-V-85) before the Zoning Board of als of the Village of Mount Prospect on the 24th day of January pursuant to due and proper notice thereof published in the Prospect Herald on the 8th day of January, 1985; and [HEREAS, Petitioner agreed to undertake certain improvements, ~ding parking lot and drive access changes, sidewalk hstruction, street lights and landscaping pursuant to a Site revised in accordance with recommendations of the Community .opment Department (a copy of which Site Plan is attached beret lade a part of this Ordinance by reference), provided the ~llation of such improvements could be delayed for one year )wing the date of this Ordinance and to thereafter be completed .n sixty (60) days; and ;HEREAS, the Zoning Board of Appeals has submitted its findings ~ecommendations to the President and Board of Trustees of the ~ge of Mount Prospect to allow the requested variation, and the ~dent and Board of Trustees of said Village have given further .deration to the variation request and have determined that the Isatisfy the standards set forth in Section 14.605 of Article VI apter 14 of the Village Code, and this Board further finds that uld be in the best interest of the Village to grant the request ariation, subject to Petitioner's installation of the Site Plan vements. OW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF EES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, WS: AS ECTION ONE: The recitals set forth hereinabove are incorporate~ n as findings of fact by the President and Board of Trustees of llage of Mount Prospect. BA' 5 ~ of 2 SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the variation reauested with respect to Sections 14.2102.C and 14.2105.B.1 respectively of Article XXI, Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the continued encroachment of access driveway across the required rear yard area and the elimination of the required truck loading area from the property in question, subject to Petitioner's installation of Site Plan improvements by no later than 60 days following one year from the date of this Ordinance. SECTION THREE: Except for the variation granted ~erein, all other applicable~Village of M~un~Prospect Ordinances and Regulations shall remain in tull force ana es~ect as to the Subject Property. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
