Published in pamphlet form by the authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 12 day of ~ay , 1985 \ 2548V ORDINANCE N0.3514~ AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 709 NOAH TERRACE IN THE VILLAGE OF MOUNT PROSPECT~ ILLINOIS WHEREAS, Mr. and Mrs. Mike M. K. Choi have filed an application for variation with respect to property commonly known as 709 Noah Terrace (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: Lot 25 in St. Cecelia Subdivision, being a resubdivision of Lot 2 and part of Lot 3 and 6 in Meier Brothers Subdivision, being a subdivision of parts of Sections 10 and 15, Township 41 North, Range 11 East of the Third Principal Meridian in Cook County, Illinois, according to the Plat thereof, registered in the office of the Registrar of Titles of Cook County, Illinois on December 26, 1978 as Document Number 3067889. WHEREAS, Petitioner, seeks the following variation from provisions of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow a 6 1/2 foot wide expansion of the driveway on the Subject Property from its present width of 18 feet as allowed Dy Section 14.116.C of Article I of said Chapter 14, to a width of 24 1/2 feet; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA-9-V-85) before the Zoning Board of Appeals of the Village of Mount Prospect on the 28th day of March, 1985, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the llth day of March, 1985; and WHEREAS, the Zoning Board of Appeals has suDmitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect to allow the requested variation, and the President and Board of Trustees of said Village have given further consideration to the variation request and have determined that the same satisfies the standards set forth in Section 14.605 Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of the Village to grant the request for variation. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinaDove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the SuDject Property the variation requested with respect to Section 14.116.C, of Article I of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow extension of the driveway on the Subject Property from i8 feet to 24 1/2 feet in width. SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: This Ordinance shall be effect from and after its passage, approval and pamphlet form in the manner provided by law. in full force and publication in PASSED and APPROVED this 7th day of May , i985.
