Published in pamphlet form by the authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 13thday of May , 1985 549V ORDINANCE NO. 3515 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 903 EAST ARDYCE LANE IN THE VILLAGE OF MOUNT PROSPECTt ILLINOIS WHEREAS, Mr. and Mrs. Joseph R. Meier have filed an application for variation with respect to property commonly Known as 903 East Ardyce Lane (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: Lot 35 in Westgate Garden Subdivision, being a subdivision of part of the Northeast quarter of the Southwest Quarter of Section 35, Township 42 North, Range 11 East of the Third Principal Meridian in Cook County, Illinois. WHEREAS, Petitioner, seeks the following variation from provisions of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow them to keep a truck of 8,000 lbs. gross weight on their residence property in variation of the provisions of Section 14.1301.B.4 of Article XIII of said Chapter 14, which prohibits the open storage of trucks and allows the garage storage of one truck not exceeding one and one-half ton capacity; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA-11-V-85) before the Zoning Board of Appeals of the Village of Mount Prospect on the 28th day of March, 1985, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the llth day of March, 1985; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect to allow the requested v~riation, and the President and Board of Trustees of said Village have given further consideration to the variation request and have determined that the same satisfies the standards set forth in Section i4.605 Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of the Village to grant the request for variation. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the variation requested with respect to Section 14.1301.B.4, of Article XIII of Chapter 14 of the Village Code of Mount Prospect, IlLinois, to allow Petitioners to keep on the Subject Property one truck with a gross vehicle weight exceeding one and a half ton capacity provided said truck is stored at all times within a garage structure on the Subject Property and shall not be allowed to be stored or located in the open~ said truck not to exceed 8,000 lbs. GVW. SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
