HomeMy WebLinkAboutOrd 3520 05/21/1985 553V ORDINANCE NO. 3520 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY CO~gONLY KNOWN AS 315 MARCELLA LANE IN THE VILLAGE OF MOUNT PROSPECTr ILLINOIS WHEREAS, Mr. and Mrs. Charles Szachowicz have filed an application for variation with respect to property commonly known 315 Marcella Lane (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: Lot 18 in Callero and Catino's St. Emily's Resubdivision being in the West half of the West half of the Southeast quarter of Section 35, Township 42 North, Range 11 East of the Third Principal Meridian in Cook County, Illinois. as WHEREAS, Petitioner, seeks a variation from the following provisions of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow a single family residence with a floor area ratio of .41 to be built on the Subject Property rather than be restricted to the floor area ratio of .35 otherwise required by Section 14.1103 of Article XI of said Chapter 14; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA-15-V-85) before the Zoning Board of Appeals of the Village of Mount Prospect on the 4th day of April, 1985, pursuant to due and proper notice thereof pubiished in the Mount Prospect Herald on the 18th day of March, 1985; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect to allow the requested variation, and the President and Board of Trustees of said Village have given further consideration to the variation request and have determined that the same satisfies the standards set forth in Section 14.605 of Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the Dest interest of the Village to grant the request for variation. TRUSTEES FOLLOWS: NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, aS SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the variation requested with respect to Section 14.1103, of Article XI of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the construction of a single family residence on the Sub3ect Property having a floor area ratio of .41 rather than a ratio of .35 otherwise required. SECTION THREE: Except for the variations granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: This Ordinance shall be effect from and after its passage, approval and pamphlet form in the manner provided by law. in full force and publication in PASSED and APPROVED this 21st day of May , 1985.
