HomeMy WebLinkAboutOrd 3533 06/04/1985 RDINANCE NO. 3533 AN ORDINANCE GRANTING SPEIFIED VARIATIONS FOR PROPERTY AT 2013 EAST EUCLID PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES THE 4th DAY OF JUNE, 1985 Published in pamphlet form by the authority of the corporate authorith of the Village of Mount Prospect, Illinois, the llth day of June, 1985 ORDINANCE NO. 3533 AN ORDINANCE GRANTING SPECIFIED VARIATIONS FOR PROPERTY AT 2013 EAST EUCLID WHEREAS, Raymond Naegele (who shall be referred to as "Petit'loner") is the owner of a parcel of property located at 2013 East Euclid in the Village of ~unt Prospect, County of Cook, State of Illinois (hereinafter referred to as the "Subject Property"); and WHEREAS, the Subject Property is legally described as follows: Lot Twenty-Four (24) in Alten's Euclid Ave. Subdivision of that part of the South 133.5 feet of the Northwest Quarter (1/4) of Section 25, Township 42 North, Range 11 East of the Third Principal Meridian, in Cook County, Illinois; and WHEREAS, the Subject Property is located in the B-3 Business Retail and Service District under the provisions of the Zoning Ordinance of the Village of Mount Prospect (hereinafter referred to as the "Zoning Ordinance"); and WHEREAS. Petitioner has heretofore filed an application seeking the following variations from the provisions of the Zoning Ordinance: A variation from Section 14.2002.A of Article XX of the Zoning Ordinance to allow parking in Eighteen (18) of the required thirty (30) foot front yard. A variation from Section 14.2002.B of Article XX of the Zoning Ordinance to permit a driveway in the required side yard on the Subject Property; and WHEREAS, a public hearing was held on the Petitioner's request for the aforesaid variations, which request is known as ZBA-10-V-85 before the Zoning Board of Appeals of the Village of Mount Prospect on March 28, 1985, pursuant to proper public notice published in the Mount Prospect Herald on March 11, 1985; and ~EREAS, the Zoning Board of Appeals has recommended to the President and Board of Trustees of the Village of Mount Prospect that Petitioner's request for the aforesaid variations, ZBA-10-V-85, be granted, except for the requested variation from Section 14.2002.B of Article XX of the Zoning Ordinance; and ~EREAS, the President and Board of Trustees have considered the Petitioner,s request and reviewed the recommendation of the Village of mount Prospect Zoning Board of Appeals in ZBA-10-V-85; and WHEREAS, the Petitioner has withdrawn his request for a variation from Section 2002.B. of Article XX of the Zoning Ordinance; and WHEREAS, the president and Board of Trustees of the village of Mount Prospect have determined that with respect to the Petitioner's requested front yard variation, that Petitioner has satisfied the standards for the granting of variations see forth in Section 14.605 of Article VI of the Zoning Ordinance and find that it would be in the best interest of the Village of Mount Prospect to grant Petitioner the requested variation, subject to certain conditions. OW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS as follows: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President Board of Trustees of the Village of Mount Prospect. and SECTION TWO: Subject to the conditions set forth in Section Three below, the President and Board of Trustees of the Village of Mount Prospect hereby grant the following variation: A variation from Section 14.2002.A. of Article XX of the Zoning Ordinance to allow parking to be located in eighteen (18) feet of the required thirty (30) foot front yard. for the Subject Property. SECTION THREE: The variations granted herein are granted subject to compliance, by the owner of the Subject Property with the following conditions: Development shall take place in general conformance to the site plan submitted and reviewed, attached hereto. Screening, acceptable to the Department of Community Development shall be provided and maintained to reduce the impact of the development along the West and South property lines. Such screening shall consist of landscaping and a six (6) foot board-on- board fence along the rear (South) property line, and repair, reinforcement, and slatting of the existing chain link fence along the side (West) property line, together with an extension of the fence along the West property line to the thirty (30) foot building line. SECTION FOUR: Except for the variations granted herein, all other applicable Village of Mount Prospect Ordinances shall remain in full force and effect as to the Subject Property. SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law. Passed this ~tb day of .Jun~ , 1985.
