Illinois, the 10th day of July 1985 720V ORDINANCE NO. __/544 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 8 SOUTH MOUNT PROSPECT ROAD IN THE VILLAGE OF MOUNT PROSPECT~ ILLINOIS WHEREAS, John E. Pohlmann has filed an application fo~ variation with respect to pxope~ty commonly known as 8 South Mount Pzospect Road, Mt. P[ospect, Illinois (the "Subject Pxope[ty"); and WHEREAS, the Subject P~operty is desczibed as follows: Lot 1 in First Addition Chellman and Pearson's Resubdivision, being a ~esubdivision of the East half of Block 1 (except the north 223.0 feet thereof) in Busse's Eastezn Addition to Mount Pzospect, in the East half of Section 12, Township 41 Nozth, Range 11 East of the Third P[inci~al Meridian, Cook County, Illinois according to the plat thereof ~egiste~ed in the Office of the Registx%z of Titles of Cook County, Illinois on May 2, 1955 as Document No~ 1591625. WHEREAS, Petitioner, seeks a variation f~om the following pxovisions of Chapte[ 14 of the Village Code of Mount Prospect, Illinois, to allow the constxuction of a new gaxage to within one foot fxom the Nozth pzope[ty line, instead of the five foot setback required by Section 14.102.B.2 of Article I, Chapter 14, and to p[ovide for a garage containing 720 square feet of a~ea [athez than 600 square feet as pezmitted by Section 14.102.B.4 of A~ticle I of said Chapte~ 14; and WHEREAS, a public hearing was held on the vaxiation [equest (designated as Case No. ZBA-27-V-85) before the Zoning Board of Appeals of the Village of Mount P[ospect on the 6th day of June, 1985, pursuant to due and p~ope~ notice thereof published in the Mount Pxospect Herald on the 20th day of May, 1985; and WHEREAS, the Zoning Boaxd of Appeals has submitted its findings and zecommendation to the Pzesident and Boa[d of Tzustees of the Village of Mount Prospect to allow the zequested variation, and the President and Board of T~ustees of said Village have given furthe~ considexation to the variation xequest and have detexmined that the same satisfies the standa[ds set foxth in Section 14.605 A~ticle VI of Chaptex 14 of the Village Code, and this Boa[d fu~the[ finds that it would be in the best intezest of the Village to gxant the xequest fox vaxiation. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The xecitals set forth he[einabove ace incoxpo[ated herein as findings of fact by the Pxesident and Board of T[ustees of the Village of Mount Pxospect. SECTION TWO: The P[esident and Boaxd of Txustees of the Village of Mount Prospect he[eby gxant to the Subject Pzopezty the variation ~equested with zespect to Sections 14.102.B.2 and B.4, of A[ticle I of Chaptez 14 of the Village Code of Mount Prospect, Illinois, to allow the constxuction of a gaxage fox the storage of moto[ vehicles, gaxden matezials and tools to within one foot from the Nozth p~operty line of the Subject Pzoperty, said gaxage to ontain 720 square feet of area; provided that no additional accessory buildings shall be erected or const[ucted upon the Subject Property~ as indicated on the Site Plan attached hereto as Exhibit "A". SECTION THREE: Except fox the variations g~anted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject P~operty. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner pzovided by law.
