HomeMy WebLinkAboutOrd 3550 08/06/1985 RDINANCE NO. 3550 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 1112 NORTH ELMHURST IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS ROAD PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES THE 6th DAY OF AUGUSTt 1985 Published in pamphlet form by the authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 12th day of august, 1985 796V/4 ORDINANCE NO. 3550 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY kNOWN AS 1112 NORTH ELMHURST ROAD IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Mr. and Mrs. Donald Davis have filed an application for variation with respect to ~roperty commonly known as 1112 North Elmhurst Road, Mount Prospect, Illinois (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: Lot 8 in Wedgewood Terrace, a Subdivision of part of the East one half of Section 27, Township 42 North, Range 11 East of the Third Principal Meridian in Cook County, Illinois. WHEREAS, Petitioner, seeks a variation from the following provisions of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow a three (3) car garage containing approximately 900 square feet of area with'a paved parking and turn-around area within the rear yard of the Subject Property in variance to Section 14.1001.B.3 providing for a maximum of two (2) car garages; Section 14.102.B.4 limiting garage structures to 600 square feet, and Section 14.1002.C requiring a 25 foot open rear yard area; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA-35-V-85) before the Zoning Board of Appeals of the Village of Mount Prospect on the 27th day of June, 1985, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the llth day of June, 1985: and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect to allow the requested variation, and the President and Board of Trustees of said Village have given further consideration to the variation request and have determined that the same satisfies the standards set forth in Section 14,605 Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of the Village to grant the request for variation, subject to the conditions hereinafter set forth. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF Tb~ VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the variation requested with respect to Sections 14.1001.B.3 and Section 14.102,B.4 and 14.1002.C of Chapter 14 of the Village Code of Mount Prospect, Illinois to allow a three (3) car garage 'containing approximately 900 square feet of garage area with a paved rear yard parking and turn around area, upon the following conditions to wit: 1. No other accessory building shall be located upon the Subject Property: . No home occupation.or business shall be conducted the Subject Property: 3. The garage structure and adjacent parking and turn-around area shall not be used for warehouse purposes or the storge of inoperable vehicles. on SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: This Ordinance shall be effect from and afte~ its passage, approval and pamphlet form in the manner provided by law. in full force and publication in PASSED and APPROVED this 6th day of Aug~ 1985.
