HomeMy WebLinkAboutOrd 3558 09/03/1985 845V ORDINANCE NO. 3558 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS THE NORTHEAST CORNER OF CARBOY AND NORDIC ROADS IN THE VILLAGE OF MOUNT PROSPECT,. ILLINOIS WHEREAS, Ulrich G. Marks has filed an application for variation with respect to property commonly known as the Northeast Corner of Carboy and Nordic Roads in the Village Mount Prospect, Illinois (the 'Subject Property"); and WHEREAS, the subject Property is described as follows: Lot 5 in Elmhurst-Algonquin Industrial Park #2 in the Southeast quarter of Section 27, Township 41 North, Range ll East of the Third Principal Meridian, in'Cook County, Illinois. WHEREAS, Petitioner, having bbtained a previous variation to reduce the number of required on-site parking spaces from 70 to 32 spaces, now seeks a further variation from the provisions of Section 14.2205.A.1 of Article XXII of Chapter 14 of the Village Code of Mount Prospect, Illinois, to further reduce the number of /equired on-site parking spaces from 32 down to 27 to accommodate the Petitioners proposed office warehouse and assembly business; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA-36-V-85) before the Zoning Board of Appeals of the Village of Mount Prospect on the 25th day of July, 1985, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 9th day of July, 1985; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect to allow the requested variation, and the President and Board of Trustees of said Village have given further consideration to the variation request and have determined that the same satisfies the standards set forth in Section 14.605 of Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of the Village to grant the request for variation provided that an approved landscape plan is implemented, as hereinafter set forth. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the variation requested with respect to Section 14.2205.A.1 of Article XXII Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow a reduction in on-site parking spaces to 27 such spaces, to be located as set forth and designated on a Site Plan which is attached hereto and made a part of this Ordinance by reference; said variation to be conditioned upon the further submission by Petitioner of a landscape plan to be approved by the Department of Planning and oning of the Village with installation of all landscaping and planting pursuant to such plan to be completed before occupancy of th~ building to be constructed upon the Subject Property. SECTION THREE: The variation granted herein, with respect to the reduction i"n required on-site parking spaces is in direct response to Petitioner's proposed use of the Subject Property and is contingent upon no subsequent interior changes or additions being made to the subject building which would alter the area used for office~ warehouse and assembly purposes so as to intensify the need for increased parking spaces. Except for the variation granted herein, all other applicable Village of Mount Prospect ordinances and regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
