Published in pamphlet form by the authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 5th day of March , 1986 356V ORDINANCE NO; ~616 AN ORDINANCE TO AMEND CHAPTER 10 ENTITLED "LICENSES AND PERMITS" OF THE VILLAGE CODE OF MOUNT PROSPECT, ILLINOIS BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: Chapter 10 entitled "Licenses and Permits" of the Village Code of Mount Prospect, Illinois (1981) as amended, is hereby further amended as follows: A. By amending Section 10.102 entitled "Application Form" of Article I of said Chapter 10 to read: "Sec. 10.102. Application Form. The application form for such license, designated in Section 10.101 above, shall require the following information. Whether the applicant is an individual, a partnership, or a corporation. B® The full name, residence address, residence phone number, and social security number for each individual applicant, partner, general partner of a limited partnership, and principal officers of a corporation. Location or proposed location of the business, occupation, or activity. D. Type of license desired. E. Length of time for which such license is desired. A statement as to whether licenses granted by any State, municipality or other licensing authority, have ever been revoked or whether such license issuance or renewal has ever been refused to the applicant or the organization he represents, and the reasons for any such revocation or refusal. A statement as to whether the applicant seeking such a license or the principal officer or officers of the organization he represents has ever been convicted of a felony, and if so, the nature thereof and penalty assessed therefor. Any additional information as may be required by this Code or by the Village Clerk." Be By amending Section 10.202 entitled "Investigation" of Article II of said Chapter 10 to read: "Sec. 10.202. Investigation. The Director of Code Enforcement shall make or cause to be made an investigation in regard to such licenses to be granted in connection with all fire prevention, building, zoning, and health matters." ection Chapter By amending Section 10.301 entitled "Building and Premises", Section 10.302 entitled "Change of Location" and Section 10.303 entitled "Nontransferability of License' of Article III of said Chapter 10 to read: "Sec. 10.301. Building and Premises. No license shall be issued for the conduct of any business, occupation or activity if the premises and building or vehicle, as the case may be, to be used for such purpose do not fully comply with all applicable provisions of this Code and Village Ordinances, including fire prevention, building, zoning, police and health. Sec. 10.302. Change of Location. The location of any licensed business or occupation, or of any permitted act, may be changed provided ten (10) days' notice thereof is given to the Village Clerk, in the absence of any provision to the contrary, and provided that the new location complies with all applicable provisions of this Code and Village Ordinances and that any increase in fees, as required by Article XXXIV of Chapter 11 of this Code, are paid. Sec. 10.303. Nontransferability of License. No license issued under this Chapter shall be transferred or assigned or used by any person other than the one to whom it is issued, except as provided for under Article XXXIV of Chapter 11 of this Code, or at any location other than the one for which it is issued, except as provided for under Section 10.302 of this Chapter." D. By amending Section 10.401 entitled "Procedure" and 18.402 entitled "Notice of Hearing" of Article IV of said 10 to read: "Sec. 10.401. Procedure. Any such license contemplated under Article I of this Chapter may be revoked by the village Manager, or an application for issuance or renewal of such license may be refused by the Village Clerk, if either determines: A. That the application of the applicant or license holder contains any false, fraudulent or misleading material statement; or Be That the applicant or license holder has made any false, fraudulent or misleading material statement, or has been convicted of perpetrating a fraud upon any person, whether or not such fraud was perpetrated in the course of conducting any business in the Village, or that the applicant or license holder has committed a felony; or Ce That the applicant or license holder has conducted any activities directly related to his business in the Village in an unlawful manner or in such a manner as to constitute a breach of the peace or a menace to the health, safety or general welfare of the public; or De That the applicant or license holder has suffered a revocation or refusal to issue or renew such license by any state, municipality or licensing authority. The applicant shall be notified of a determination to revoke or refuse issuance or renewal of the license contemplated by the Village official making such determination; which notice shall provide the applicant with a right to request a hearing before the said Village official regarding his proposed action. -2- ection 10.402. Notice of Hearing. Notice provided for in Section 10.401 above shall be given in writing to the applicant or license holder as the case may be, and shall contain the reasons for the determination to revoke or refuse to issue or renew a license. ae Such notice shall be mailed, postage prepaid, to the applicant or license holder, as the case may be, at his last known address and shall provide the applicant with the right to request a hearing before the village offical involved within eight (8) days following the date such notice was placed in the mail. If no such request for a hearing is received the Village official's determination shall become final. The applicant or license holder, as the case may be, shall have the right to be represented at such hearing by counsel. At the conclusion of the hearing the Village official involved shall issue his decision to affirm or to reverse the determination to revoke or to refuse to issue or renew the license contemplated and shall mail the same to the applicant or license holder; which decision shall be mailed within two (2) days following the conclusion of the hearing or the receipt of any transcript thereof, whichever is the latest to occur." SECTION TWO: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
