"-=- .~ ~ J RESOLUTION NO. 41-85 A RESOLUTION TO AUTHORIZE THE EXECUTION OF SANITARY SEWER REHABILITATION PROGRAM CONTRACT B WITH NATIONAL POWER RODDING WHEREAS, this Board pursuant to bid advertising did, on January 15, 1985 authorize award of Sanitary Sewer Rehabilitation Program Contract "B" to National Power Rodding¡ and WHEREAS, said Contract was conditioned upon the disposition of a protest filed by Video and Sealing, an unsuccessful bidder with respect to such Contract; and WHEREAS, such protest was considered by this Village and dismissed, and was subsequently considered by the USEPA and was dismissed, but is presently the subject of a request for reconsideration made by Video and Sealing to the USEPA; and WHEREAS, pending final action by the USEPA such agency and the IEPA have, and continue to, withhold approval of the said Contract "B" to National Power Rodding; and WHEREAS, such approval by USEPA and the IEPA is not required in order for the Village to complete its award of Contract "B" and to commence work thereunder; and WHEREAS, both the Village Attorney and the Project Engineers have examined the subject protest and have advised the Village that the same lacks merit both from a jurisdictional as well as a factual basis; and. WHEREAS, to further delay the award of Contract "B" will jeopardize the progess of the Sanitary Sewer Rehabilitation Program and will jeopardize the ability of the Village to fulfill such contract obligations without an increase in cost, which increase would not be considered for Federal grant participation; and WHEREAS, it is deemed to be in the best interest of this Village that Contract "B" be awarded and that work thereunder commence without further delay. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: This Board does hereby approve and authorize the execution of Contract "B" with National Power Rodding, and the Mayor and Village Clerk are authorized and directed to execute the same and to take all further steps deemed necessary to allow work to commence pursuant to this Contract. SECTION TWO: This Resolution shall be in full force and effect upon it passage and approval in accordance with law.
