RDINANCE NO. 3625 ORDINANCE TO AMEND CHAPTER 14 ENTITLED "ZONING" OF THE VILLAGE CODE OF MOUNT PROSPECT, ILLINOIS TO PROVIDE FOR CERTAIN CHANGES TO THE ZONING CODE WHEREAS, the Planning and Zoning Department of the Village of Mount Prospect has proposed amendments to the Zoning Ordinance to provide for changes to minimum lot width and area required for construction in the R-X, R-A, and R-1 Districts; and WHEREAS, a public hearing was held on said amendments, designated as Case No. ZBA-2-A-86 before the Zoning Board of Appeals of the Village of Mount Prospect on the 9th of January, and the 13th of February, 1986 pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 24th day of December, 1985~ and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations to the Board of Trustees of the Village of Mount Prospect~ and WHEREAS, the President and Board of Trustees have considered further the amendments and the findings and recommendations of the Zoning Board of Appeals and have determined that it is in the best interest of the community grant the amendment request. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: Chapter 14 entitled "Zoning" of the Village Code of Mount Prospect, Illinois, 1981, as amended, is hereby further amended by amending Section 14.107 entitled "Nonconforming Uses" of Article I of said Chapter 14 as follows: A. By adding a new Subsection D of Section 14.107 to read as follows: 14.107.D. Any existing lot properly subdivided as defined by this Ordinance, which does not meet the lot width or lot area require- ment, and is currently zoned R-X, R-A, or R-1 shall be allowed to have permits issued for construction of a single family residence or other permitted or special use, provided: 1. The residence shall meet all other requirements of this Chapter; The lot in question shall not have been relied upon by adjacent properties, whether currently under separate or common ownership, for compliance with the requirements of this Chapter. The lot in question is representative of other lots in the neighborhood and does not differ significantly, as deter- mined by the Zoning Administrator, in lot width or area from other, similarly situated properties in the general area. SECTION TWO: This and after its passage, approved by law. Ordinance shall be in full force and effect from approval and publication in pamphlet form as AYES: Arthur, Farley, Floros, Murauskls, NAYS: None PASSED and APPROVED this lSth day of Van Geem, Wattenberg March , 1986.
