Published in pamphlet form by the authority of the corporate authorities of the Village of Mount Prospect, illinois, the 2nd day of April , 1986 405S ORDINANCE N0.3629 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS RANDHURST SHOPPING CENTER, 999 ELMHURST ROAD IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Acme-Wiley Corporation has filed an application for variation with respect to property commonly known as Randhurst Shopping Center, 999 Elmhurst Road in the Village of Mount Prospect, Illinois (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: The West half of the Southeast quarter of Section 27, Township 42 North, Range 11 East of the Third Principal Meridian (except that part thereof falling in a 100.0 foot strip conveyed to the County of Cook by deed recorded May 6, 1941 as Document No. 12674702 and filed May 6, 1941 as Document No. L.R. 895623, the center line of which is described as follows: Beginning at the Northwest corner of the Southeast quarter of Section 27, aforesaid; thence East along the North line of said Southeast quarter, a distance of 550.0 feet to a point of curve; thence in a generally Easterly direction along a curved line tangent to said North line of the Southeast quarter. Convexed Northerly and having a radius of 24,555.35 feet. A distance of 1028.57 feet to a point of tangency; thence in a generally Easterly direction along a straight line. Tangent to the last described curved line. A distance of 165.03 feet to a point of curve; thence in a generally Easterly direction along a curved line tangent to the last described straight line. Convexed Southerly and having a radius of 24,555.35 feet, for a distance of 1028.57 feet.) also The West 460.0 feet as measured along the North line thereof, of the East half of the Southeast quarter of Section 27, Township 42 North. Range 11 East of the Third Principal Meridian (except that part thereof falling in a 100.0 foot strip conveyed to the County of Cook by deed recorded October 8, 1941 as Document No. 1277139. The center line of which is described as follows; Beginning at the Northwest corner of the Southeast quarter of Section 27, aforesaid: thence East along the North line of said Southeast quarter, a distance of 550.0 feet to a point of curve; thence in a generally Easterly direction signs a curved line tangent'is said North line of the Southeast quarter, convexed Northerly, and having a radius of 24,555.35 feet. A distance of 1028.57 feet to a point of tangency; thence in a generally Easterly direction along a straight line tangent to the last described curved line, a distance of 165.03 feet to a point of curve; thence in a generally Easterly direction along a curved line tangent to the last described straight line. Convexed Southerly and having a radius of 24,555.35 feet, for a distance of 1028.57 feet and also except the North 70.0 feet of the West 70.0 feet of the South 120.0 feet of said East half of the Southeast quarter of Section 27) all in Cook County, Illinois. WHEREAS, Petitioner, seeks a variation from the following provisions of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow expansion or alteration of a non-conforming structure by permitting the alteration of the presently non- conforming Wards Auto Center free standing sign located on Kensington Road pursuant to Section 14.604.A.5 of Article VI, Chapter 14; and WHEREAS, public hearings were held on the variation request (designated ~s Case No. ZBA-71-V-85) before the Zoning Board of Appeals of the Village of Mount Prospect on the 21st day of November, 1985, the 19th day of December, 1985 and the 27th day of February, 1986, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 5th day of November, 1985; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect to allow the requested variation, and the President and Board of Trustees of the Village have given further consideration to the variation request and have determined that the same satisfies the standards set forth in Section 14.605 of Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of the Village to grant the request for variation. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, FOLLOWS: AS SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the variation requested with respect to Section 14.604.A.5 of Article VI of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the expansion or alteration of a non-conforming structure by permitting the alteration of the presently non-conforming free standing Wards Auto Center sign in accordance with plans and specifications therefor submitted by Petitioner. SECTION THREE: The Variation hereby granted is subject to the express condition and understanding that the Petitioner shall remove the above described sign from the Subject Property no later than June 30, 1989 at which time this Variation shall lapse and be of no further effect. SECTION FOUR: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property. SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
