DEMPSTER STREET / MYERS PLAT OF EASEMENT The petitioner seeks approval of a Plat of Easement for the property located at 1501 aR '"1585 W. Dempster Street. The Plat of Easement was a requirement of the Planned Unit Development consisting of an existing restaurant with a drive - through and a new mixed -use building that was approved for the subject property. The Plat of Easement dedicates an easement to the Village of Mount Prospect for water main purposes. Staff has reviewed the plat and found it to be prepared according to all Village codes and requirements. Please forward this memorandum and attachments to the Village Board for their review and consideration at their November 7, 2012 meeting. The other items they identified were administrative items. However, one item has to do with the Village Manager's auto allowance. The allowance has been part of his salary agreement since his start date in 1992 and the Village and the Manager have paid the required taxes and IMRF contribution amounts since the beginning of the agreement. However, there was no IMRF resolution "officially" stating the Village considered the auto allowance as compensable wages and as IMRF earnings for contribution purposes. The revised agreement addresses some programmatic modifications recently implemented by the OSFM. The agreement will allow the Village to operate a local elevator safety program in lieu of the OSFM performing these duties within Mount Prospect. The proposed resolution will terminate the existing agreement between the two parties and authorize the execution of the revised agreement. Upon execution, the agreement will be valid for a period of four (4) years. Staff recommends the Village Board approve the resolution authorizing the execution of an agreement with the Office of the State Fire Marshal. All Municipalities and Counties with a Current Local Agreement RE: Revised Municipality Agreement Enclosed, please fund a revised Illinois Elevator Safety Program Agreement which has been prepared by the Office of the State Fire Marshal ( "OSFM ") for your review and sig;itature. The revisions included in this Agreement reflect important changes made to the Illinois Elevator Safety Rules, which became effective on Octci�er 1, 2012. Updated 10/10/12 f - Pat Quinn, Governor Larry Matkaitis, State Fire Marshal Office of the State Hire Marshal ILLINOIS ELEVATOR SAFETY PROGRAM AGREEMENT This Agreement is made between the Office of the State Eire Marshal ( "OSFM") and the municipality or county ( "Local Authority") as hereinafter identified. This Agreement constitutes a contract between the OSFM and Local Authority which permits the Local Authority to operate an Elevator Safety Program ( "Program ") in conformity with Section 140 of the Elevator-Safety Act (225 IL:S 322;140) and the Administrative Rules adopted at -41 lll: -Adm: Code 14(34: In that regard, the Local Authority agrees to the following. 1. This Agreement will become effective on the date it is accepted by the OSFM and shall remain valid for a period of four (4) calendar years thereafter. Prior to the expiration of this Agreement, the Local Authority shall reapply for approval of its PROGRAM by submitting to the OSFM the information detailed in Section 2, below. 2. The Local Authority shall submit to the OSFM, along with this Agreement executed by an officer of the Local Authority, the following information and shall notify the OSFM in writing of any changes to subsections "A" and "B" thereafter during the terra of this Agreement; A. The name and contact information of its Program administrator. It is the responsibility of the Local Authority to notify the OSFM of any changes to this information. B. The name and contact information of any third party inspection Company /ies under contract with the Local Authority or the name and license number of the inspector(s) employed by the Local Authority to perform such inspections. C. The number and type of conveyances covered by the Program. D. The number and type of conveyances NOT covered by the Program, if any. These records shall be maintained by the Local Authority. 3. The Local Authority, by signing this Agreement, attests to the OSFM that it will enforce safety standards, codes and regulations at least as stringent as those adopted in the current version of the Illinois Elevator Safety Rules, 41 III. Adm. Code 100.60. The Local Authority also agrees to amend and enforce its Program, as required by Section 6(1) of this Agreement,. to reflect.: subsequent amendments to the safety standards, codes and regulations adopted by the Illinois Elevator Safety Rules. 4. Should the Local Authority desire to amend any of the Standards, the Local Authority must submit to the OSFM, for approval by the Illinois Elevator Safety Review Board ("Board"), a copy of the amendment and its reason for the change. The Board shall review the amendment and notify the Local Authority no later than 30 days after the Board meeting at which the variance request is heard of its approval or denial. 5. With respect to ASME A17.3 -2005, Safety Code for Existing Elevators and Escalators, upgrades required by Section 35(h) must be completed no later than January 1, 2015. By signing this Agreement, the Local Administrator recognizes that Public Act 97 -1048 adjusted the compliance date for upgrade requirements to the restricted opening of hoistway doors or car floors on passenger elevators from January 1, 2015 to January 1, 2014. An existing conveyance is a conveyance located in a building for which a building permit was issued prior to the effective date of the Administrative Rules which were adopted in conformance with the Elevator Safety and Regulation Act. 6.. The Local Authority by signing this Agreement agrees to operate its Program in compliance and conformance with the Elevator Safety and Regulation Act and Administrative Rules- tinder the Program, the Local Authority shall: A. Issue construction and alteration permits and certificates of operation. B. C. Ia E. F. Consider requests to extend the time frame for construction or alteration permits. Such requests shall be granted for an additional 12 months if the request is received by the Local Authority prior to expiration of the existing permit. Extension requests received by the Local Authority after the expiration of the existing permit shall be denied, requiring a new application that must be accompanied by payment of the current fee charged by the Local Authority. Provide for inspection of elevators, including temporary operation inspections. Grant exceptions and variances from the literal requirements of applicable State codes, standards and regulations in cases in which such variances would not jeopardize the public safety and welfare. The OSFM shall be notified immediately by mail of any exception or variance granted. The OSFM may object to such exception or variance within 7 business days of receipt of the notice. Should the OSFM and Loral Authority not reach agreement on the exception or variance, the matter shall be directed to the Elevator Safety Review Board ( ") to hear and decide. Enforce the applicable provisions of the Elevator Safety Act, and levy fines in accordance with the Municipal Code [65 ILCS 5] or Counties Code j55 ILCS 51. Maintain for inspection by the OSFM the following documentation and information, all of which shall be maintained for a 2 -year period: 1) All permit applications; 2) All permits issued by the Local Authority; 3) All exceptions orvariances granted or denied; 4) All inspection reports for conveyances subject to the Program; and 5) Proper records demonstrating the number of certificates of operation issued by the Local Authority 2 G_ Ensure that all inspections are performed by personnel properly licensed by the State. H. Notify the OSFM of any instances of non- compliance with the Elevator Safety Act and /or Administrative Rules of which it becomes aware. L Amend its Program within 94 days of receipt of notice from the OSFM informing them of changes to any form, document, the Standards and/or rules that affect the Program. I To notify the OSFM at least 90 days in advance of the date the Local Authority elects to discontinue its Program. K. To require all conveyances in its jurisdiction to register and pay the associated fee to the OSFM and to put out -of- service and report to the OSFM the names of the owners of those conveyances that fail to register within 30 days of determination "that the conveyance is not registered. L To make itself available, upon reasonable notice, to meet with the Administrator or its representatives, to ensure compliance with the Elevator Safety Act and Administrative Rules. 7. In accordance with the Elevator Safety and Regulation Act and the Administrative Rules, with the exception of the registration fees, the fees and procedures for applications, permits, inspection and enforcement under the Local Authority's Program shall remain the jurisdiction of the Local Authority and such procedures shall take precedence over the procedures adopted by the OSFM and Board. 8. Should the OSFM determine that the Program does not meet the requirements of the Elevator Safety and Regulation Act or the Administrative Rules, the OSFM shall notify the Local Authority of the corrective actions needed to bring the Program into compliance. Should the Local Authority fail to make the corrections, the OSFM may, after allowing time for corrective action and after a hearing under Section 160 of the Administrative Rules, withdraw approval of the Program. 9. A RESOLUTION AUTHORIZING AN AGREEMENT WITH THE OFFICE OF THE STATE FIRE MARSHAL THAT ALLOWS THE VILLAGE TO OPERATE AN ELEVATOR SAFETY PROGRAM AND TERMINATES A PRIOR SIMILAR AGREEMENT WITH THE OFFICE OF STATE FIRE MARSHAL WHEREAS, in 2007 the State of Illinois adopted the Elevator Safety Act, 225 ILCS 312/1 et seq., which regulates the construction of new elevators and the semi - annual inspection and enforcement of existing elevators; and WHEREAS, in order for the Village of Mount Prospect to maintain a local elevator inspection program, the Village must enter into an agreement with the Office of the State Fire Marshal (OSFM) that permits the Village to operate an Elevator Safety Program in conformity with Section 140 of the Elevator Safety Act, 225 ILCS 312/140, and the Administrative Rules adopted at 41 III. Adm. Code 1000; and WHEREAS, the Village entered into a similar agreement with the OSFM on April 29, 2008, pursuant to Resolution No. 19 -08 (the "Initial Agreement'), and OSFM has requested the Village to enter into a revised agreement (the "Revised Agreement "), which addresses programmatic modifications implemented by the OSFM; and WHEREAS, the President and Board of Trustees believe is in the best interest of the Village, its residents and businesses to maintain local authority of its elevator inspection program. NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, PURSUANT TO ITS HOME RULE POWERS: SECTION ONE: That the President and Board of Trustees of the Village of Mount Prospect hereby authorize the Village's Director of Community Development to execute the Revised Agreement with the Office of the State Fire Marshal, a copy of which is attached hereto and made a part hereof as Exhibit "A." JANONIS, VILLAGE MANAGER FROM: FINANCE DIRECTOR a :L DATE: NOVEMBER 1, 2012 SUBJECT: 2012 BUDGET AMENDMENT NO. 2 PURPOSE: Present a recommendation that the annual budget be amended for fiscal year beginni January 1, 2012 and ending December 31, 2012. BACKGROUND: Ordinance 5891, adopted December 20, 2011, established the annual budget for the year ending December 31, 2012. Ordinance 6001 adopted on April 3, 2012 provided for amendment #1 of the 2012 budget. DISCUSSION: Each year the Village prepares two or more amendments impacting revenues and /or expenses to the current year's budget. The first of these amendments is typically prepared in Spring and amends the budget for carry-over items from the prior year's budget. Accounts adjusted in the first amendment are typically for capital projects started in the previous year but not completed. The amendment being brought forward for consideration adjusts the budget for material variations in revenues and expenditures that are the result of fluctuations in the economy affecting revenues (either positively or negatively) or extraordinary or unanticipated charges for expenditures that occur during the year. These amendments are a necessary housekeeping process to comply with the Budget Officer Act. A proposed ordinance amending the 2012 annual budget is attached for the Board's consideration. In total, this amendment increases revenue projections by $1,493,056 and increases the budget for expenditures by $1,198,596. Adjustments to the budget impacting revenues are made up of various adjustments to tax, fee and other intergovernmental revenue accounts, grant receipts, fines & forfeits and other revenue. Amendments made to one particular Fund worth noting are those made to the Business District Fund. This is the fund that tracks the pass- through revenue and expenses related to the Randhurst Redevelopment Agreement (RDA). The Randhurst RDA requires that certain dedicated revenues generated from that site be remitted back to the developer. These revenues include the Food & Beverage Tax, Hotel /Motel Tax, Movie Theatre Tax and Business District Tax. There was no amount included in the original 2012 budget as the development was not fully operational at the time the budget was prepared. It is now estimated that a total of $630,800 in revenue sources will be generated from the Randhurst development during 2012. 2012 Budget Amendment No. 2 November 1, 2012 Page 2 Adjustments to the budget impacting expenditures are made up of adjustments to personal service, employee benefit, contractual, capital equipment and debt service accounts. Of the $1.2 million in total amendments, $482,000 occurs in the General Fund, $415,000 occurs in the Business District Fund and $104,000 occurs in the Vehicle Maintenance Fund. The balance of amendments is spread out among six (6) other Village Funds. RECOMMENDATION: It is recommended the Village Board adopt the proposed budget amendment #2 for the 2012 annual budget. JANONIS FROM: DEPUTY DIRECTOR DATE: OCTOBER 30, 2012 SUBJECT: SURPLUS FIRE ADMINISTRATION FURNITURE SOLD THROUGH ONLINE AUCTION SERVICES The Fire Department recently received approval from the Village board to purchase new furniture for the Fire Administration offices. The existing furniture exceeds an estimated surplus value of $100, thus we are seeking Board approval to sell the surplus furniture through online auction services. Attached is an ordinance that allows us to sell our surplus items using GovDeals Internet auction. We have successfully utilized GovDeals in the past to auction a range of surplus equipment, vehicles, and office furniture. We can utilize this method at any time. It allows us a cost effective alternative to sell our surplus property nationwide. The total administrative fee for utilizing this service is 7.5% of the final sales price; which we can recover from the buyer. The inventory of furniture to be sold includes several large conference room tables, office desks, book cases, and chairs. Attached you will find a detailed listing of all items to be sold. The furniture will be placed for auction during the month of November with the furniture available for pickup after December 10, 2012. SECTION FOUR: No bid shall be accepted for the sale of any item which is less than the minimum value set forth on Exhibit unless the Village Manager or the designee of the Village Manager so authorizes at the time of the auction.
