Published in pamphlet form by the authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 4th day of J~]~e , 1986 501K ORDINANCE NO; 3655 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WITH RESPECT TO ZONING CERTAIN PROPERTY LOCATED ON THE WEST SIDE OF BU$SE ROAD APPROXIMATELY 800 FEET NORTH OF THE NORTHWEST TOLLWAY IN THE I-1 LIGHT INDUSTRIAL DISTRICT WHEREAS, Wilbert F. Rosenow of Niles, Illinois, Hans Rosenow Roofing Co. and Janice Building Corporation (collectively the "Petitioner") have petitioned to rezone certain property hereinafter described from the R-X Single Family Residence District to the I-1 Light Industrial ~District in order to allow Petitioner to complete development of a commercial condominium development; and WHEREAS, the Subject Property is legally described as follows: The South 12 acres of the North 20 acres and the North 16.5 feet of the South 20 acres of the North 40 acres all in the East half of the Southeast quarter of Section 22, Township 41 North, Range 11, East of the third principal meridian, (except that part thereof lying within the Illinois State Toll Highway Commission right-of-way as shown in the deed thereto recorded in the Recorder's Office of Cook County, Illinois, on November 9, 1956 as Document No. 16751119 and except that part lying Southwesterly of the Southwesterly line of said Illinois State Toll Highway Commission right-of-way and except that part of the West 210 feet, measured at right angles to the West line thereof, lying Northeasterly of the Northeasterly line of said Illinois State Toll Highway Commission right-of-way, and except that part falling in Busse Road), in Cook County, Illinois. WHEREAS, a public hearing was held on said rezoning request (designated as Case No. ZBA-Z-86) before the Zoning Board of Appeals of the Village of Mount Prospect on the 13th day of February, 1986, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 27th day of January, 1986; and WHEREAS, the Zoning Board of Appeals has submitted its finding and recommendation to the President and Board of Trustees of the Village of Mount Prospect that the requested rezoning be approved subject to the Petitioner's compliance with the following conditions: That no outside storage of equipment or material shall be permitted on the site. Petitioner is to cooperate with the Department of Plann~n~ and Zoning as to development of a suitable Parking Plan, Landscape Plan and Storm Water Detention Plan. WHEREAS, the President and Board of Trustees have considered further the finding and recommendation of the Zoning Board of Appeals and Petitioner's request and have determined that the best interest of the Village of Mount Prospect would be obtained by the adoption of the necessary Ordinance to accomplish said rezoning upon the conditions hereinabove set forth. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The Zoning Ordinance (Chapter 14 entitled "Zoning" of the Village Code of Mount Prospect, Illinois as amended) is hereby further amended to rezone and reclassify from the R-X Single Family Residence District to the I-1 Light Industrial District the Subject Property as described above. SECTION THREE: Said rezoning of the Subject Property shall be conditioned upon compliance with those conditions enumerated above as recommended by the Zoning Board of Appeals of this Village. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet forTM in the manner provided by law.
