Published in pamphlet form by the authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 4th day of June , 1986 RDINANCE NO. 3662 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 1206 WESTGATE LANE IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Mr. and Mrs. John O'Connell have filed an application for variation with respect to property commonlY known as 1206 Westgate Lane in the Village of Mount Prospect, Illinois (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: Lot 560 in Brickman Ma~or First Addition Unit ~4, being a Subdivision in the South half of Section 26, Township 42 North, Range 11~ East of the Third Principal Meridian in Cook County~ Illionis WHEREAS, Petitioner seeks the following variation from provisions of Section 21.601.A.3 of Chapter 21 of the Village Code of Mount Prospect, Illinois, to allow the construction of a five foot high fence up to the front building of the Subject Property line parallel to Euclid Avenue; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA-22-V-86) before the Zoning Board of Appeals in the Village of Mount Prospect on the 8th day of May, 1986, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 17th day of October, 1986; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect to allow the requested variation, and the President and Board of Trustees of said Village have given further consideration to the variation request and have determined that the same satisfies the standards set forth in Section 14.605 of Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of the Village to grant the request for variation. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President of Trustees of the Village of Mount Prospect. and Board SECTION TWO: The preSident and Board of Trustees of the Village of MoUnt Prospect hereby grant to the Subject Property the variation requested with respect to Section 21.601.A.3 of Article VII of Chapter 21 of the Village Code of Mount Prospect, Illinois, to allow erection of the five foot high fence up to the front building line of the Subject Property parallel to Euclid Avenue. SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: This Ordinance Shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
