Published in pamphlet form by the authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 4th day of June , 1986 ORDINANCE NO. 3663 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 10 NORTH EMERSON STREET IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Mr. Wladyslaw Partyka has filed an application for variation with respect to property commonly known as 10 North Emerson Street in the Village of Mount Prospect, Illinois (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: Lot 104 (except the South 25 feet thereof) and all of the lot 105 in Londermilk Villa, a Sub- division in the Southeast 1/4 of Section 34, Towhship 42 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois WHEREAS, Petitioner seeks a variation from the following provisions of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the construction of an accessory shed located in the rear yard of the Subject Property at a height of twelve feet (12') instead of the maximum height of ten feet (10') otherwise allowed by Section 14.102.B.3 of Article I of said Chapter 14 and to allow for a square footage of 144 square feet instead of the maximum of 120 square feet permitted by Section 14.102.B.4 of Article 1 of said Chapter 14; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA-23-V-86) before the Zoning Board of Appeals of the Village of Mount Prospect on the 28th day of May, 1986, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 17th day of April, 1986; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect to allow the requested variation, and the President and Board of Trustees of the Village have given further consideration to the variation request and have determined that the same satisfies the standards set forth in Section 14.605 of Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of the Village to grant the request for variation. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: the recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the variation requested with respect to Section 14.102.B.3, of Article I of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the construction of an accessory shed at a height of twelve feet (12') and to allow for a square footage of 144 square feet instead of the maximum of 120 square feet permitted by Section 14.102.B.4 of Article 1 of Chapter 14 of the Village Code of Mount Prospect. SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
