New Business 09/18/2012Village of Mount Prospect Mount Prospect, Illinois INTEROFFICE MEMORANDUM 1 li TO: MAYOR AND VILLAGE BOARD OF TRUSTEES FROM: ASSISTANT VILLAGE MANAGER DATE: SEPTEMBER 12, 2012 SUBJECT: IMRF RESOLUTION — MODIFY CLASSIFICATION OF VILLAGE CLERK The Village Board approved a resolution on November 20, 1979 authorizing all elected officials (Mayor, Trustees, and Village Clerk) to participate in IMRF if they so desired by establishing a 600 hour rule minimum as annual hours worked. Subsequent resolutions, i.e. September 20, 2005, changed the threshold minimum number of hours worked to participate in IMRF to 1000 for the Mayor and Trustees, but not the Village Clerk, since the Village Clerk had long been changed to an appointed position instead of elected. During a recent audit by IMRF, the Village was advised to remove the Village Clerk from the resolution of 1979 since the Village Clerk is now a full time appointed position that obviously works more than 1000 hours per year. The attached resolution revises the Village Clerk status from the 1979 resolution as an elected Village Clerk to a full time appointed Village Clerk. This revision is at the request of IMRF for their permanent records. I would recommend Village Board approval of this resolution. DAVID STRAHL c: Village Manager Michael E. A RESOLUTION AMENDING RESOLUTION NUMBER 24 -77 RELATING TO PARTICIPATION BY PART -TIME ELECTED OFFICIALS IN THE ILLINOIS MUNICIPAL RETIREMENT FUND WHEREAS, the Village of Mount Prospect (the "Village ") and various employees of the Village are participants in the Illinois Municipal Retirement Fund ( "IMRF "); and WHEREAS, elected officials may also participate in IMRF if they are in positions that normally require performance of duty of a certain minimum number of hours or more per year; and WHEREAS, Resolution No. 24 -77 was adopted by the Village Board on June 21, 1977, by which Resolution the Mayor and Board of Trustees found that "the positions of the following part -time elected officials normally require the performance of duty during 600 hours or more a year: Mayor (Village President), Village Clerk, and Village Trustees (six) ", which number of hours was then required for eligibility to participate in FV RF; and WHEREAS, the Village Clerk was thereafter declared to be subject to appointment of the Village Manager and approval of the President and Board of Trustees, and not an elected official, pursuant to a special election that was held on November 10, 1979, and Ordinance Number 2964, adopted on November 20, 1979; and WHEREAS, Resolution No. 1 -82 was thereafter adopted by the Mayor and Board of Trustees on January 5, 1982, to exclude from participation in IMRF all officials and employees in positions normally requiring performance of duty of less than 1,000 hours per year, said requirement being applicable to those who first occupy offices or positions after adoption of that Resolution; and WHEREAS, the Mayor and Board of Trustees can determine what the normal annual hourly requirements of its elected officials are, and should make such determination for the guidance and direction of the Board of Trustees of the Illinois Municipal Retirement Fund. NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES OF THE VILLAGE MOUNT PROSPECT, COOK COUNTY, ILLINOIS, PURSUANT TO ITS HOME RULE POWERS: forth. SECTION 1 : The recitals set forth above are incorporated herein as if fully set 293090 1 SECTION 2 : That Resolution No. 24 -77 is hereby amended to replace the findings of the Mayor and Board of Trustees in Section One of that Resolution with the following: That the Mayor and Board of Trustees finds that the positions of the following part -time elected officials normally require the performance of duty of 1,000 hours or more a year: Mayor (Village President) and Village Trustees (six). SECTION 3: That the Village Treasurer - Comptroller is hereby directed to file a certified copy of this Resolution with the Illinois Municipal Retirement Fund and that this Resolution and the finding made herein shall remain in full force and effect until rescinded and the Illinois Municipal Retirement Fund is notified in writing of the rescission. A RESOLUTION AMENDING RESOLUTION NUMBER 07 -11 RELATING TO THE APPOINTMENTS OF A DIRECTOR AND ALTERNATE DIRECTORS TO THE SOLID WASTE AGENCY OF NORTHERN COOK COUNTY BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS ACTING IN THE EXERCISE OF THEIR HOME RULE POWERS: SECTION ONE The Village of Mount Prospect is a member of the Solid Waste Agency of Northern Cook County (the "Agency ") and, pursuant to the Agency Agreement establishing the Agency, is entitled to appoint a Director and one or more Alternate Directors to the Board of Directors of the Agency. SECTION TWO: By Resolution Number 07 -11 the President and Board of Trustees of the Village of Mount Prospect appointed Trustee Paul Wm. Hoefert as a Director on the Board of Directors of the Agency, and Trustee Michael A. Zadel and Mayor Irvana K. Wilks as Alternate Directors, in each case for a term expiring April 30, 2013, or until a successor is appointed. SECTION THREE: Resolution 07 -11 is amended to acknowledge the resignation of Trustee Michael A. Zadel effective September 18, 2012 and authorize the appointment of Trustee A. John Korn and Trustee Steve S. Polit to serve as Alternate Directors to fulfill the unexpired term of Trustee Zadel. SECTION FOUR The President and Board of Trustees of the Village of Mount Prospect appoint Trustee A. John Korn and Trustee Steve S. Polit as Alternate Directors, for a term expiring April 30, 2013. JANONIS FROM: VEHICLE/EQUIPMENT MAINTENANCE SUPERINTENDENT DATE: SEPTEMBER 11, 2012 SUBJECT: SURPLUS VEHICLES/EQUIPMENT SOLD THROUGH THE NORTHWEST MUNICIPAL CONFERENCE AUCTION OR GOVDEALS ON -LINE AUCTION We have received and /or placed into service various new vehicles and equipment and need to sell our old surplus vehicles and equipment that are no longer needed. I have attached an ordinance that allows us to sell our surplus items using one of the following two (2) optional ways: Live public auction or GovDeals Internet auction. We will utilize the disposal option to be in the best interest of the Village for each item. As you are aware, each year the Northwest Municipal Conference hosts live vehicle auctions in the spring and fall. This year the Village of Arlington Heights will be hosting the fall auction on Saturday, October 20, 2012, at their Public Works Facility, located at 222 N. Ridge Ave. Registration and vehicle /equipment inspections will begin at 8:00 a.m., with the live auction set to begin at 10:00 a.m. There is a 5% administration fee charged to the member communities and the buyer will pay a 10% administrative fee. GovDeals Internet auction has provided another way to maximize our revenue stream from our surplus property that is no longer needed. We can utilize this method at any time and allows us a cost effective alternative to sell our surplus property nationwide. The total administrative fee for utilizing this service is 7.5% of the final sales price. This cost can be assigned to the buyer (on top of the sales price). The Village currently has 10 cars and 10 trucks that will be eligible for disposal as surplus property at the October live auction or shortly thereafter on govdeals.com. Attached is an ordinance declaring twenty (20) soon to be retired vehicles surplus. With your concurrence, I would like to present this ordinance to the Mayor and Board of Trustees for their consideration at the September 18, 2012 Village Board Meeting. L,/James R. AN ORDINANCE AUTHORIZING THE SALE OF CERTAIN PERSONAL PROPERTY OWNED BY THE VILLAGE OF MOUNT PROSPECT WHEREAS, in the opinion of the corporate authorities of the Village of Mount Prospect, Cook County, Illinois, it has been determined that it is no longer necessary, useful, or in the best interest of the Village of Mount Prospect to retain the personal property specified herein; and WHEREAS, it has been determined by the President and Board of Trustees of the Village of Mount Prospect that the best interests of the Village would be served by the sale of the personal property at a public auction conducted by either the Northwest Municipal Conference ( "NWMC "), or an online auction service known as www.aovdeals.com: NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS ACTING IN THE EXERCISE OF THEIR HOME RULE POWER: SECTION ONE: In accordance with the provisions of Section 65 5/11 -76 -4 of the Illinois Compiled Statutes, the corporate authorities of the Village of Mount Prospect find that the items of personal property listed on the attached Exhibit A; which are owned by the Village of Mount Prospect, are no longer useful or necessary to the Village and that the best interests of the Village will be served by selling said personal property at auction to the highest bidder. SECTION TWO: The Northwest Municipal Conference intends to conduct a public auction on Saturday, October 20, 2012 at the Village of Arlington Heights Public Works facility. The www.aovdeals.com service is ongoing and can take listings at any time. SECTION THREE: The Village Manager is hereby authorized to dispose of the property set forth in Exhibit A either at the NWMC auction or through www.aovdeals.com and if through www.aovdeals.com to pay up to a 7.5% brokerage fee on all gross receipts. SECTION FOUR: No bid shall be accepted for the sale of any item which is less than the minimum value set forth on Exhibit A unless the Village Manager or the designee of the Village Manager so authorizes at the time of the auction. SECTION FIVE: Within ten (10) days after the successful bid is accepted, the successful bidder shall tender to the Village of Mount Prospect the consideration specified in the bid accepted and upon receipt of such consideration, the Village 257390_1 Manager is hereby authorized to transfer title of said person property to the successful bidder.
