Published in pamphlet form by the authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 18th day of December , 1985 180V/4 ORDINANCE NO. 3591 AN ORDINANCE GRANTING A REZONING FOR CERTAIN PROPERTY COMMONLY KNOWN AS 1758-1776 WEST ALGONQUIN ROAD IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Bresler Realty Company, has filed an application for rezoning with respect to property commonly known as the 1758-1776 West Algonquin Road in the Village of Mount Prospect, Illinois (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: The West 206 feet as measured along the North line of said Section 22 of that part of Lot 2 in Edward Busse's Division of part of the Southeast Quarter of Section 15 and the Northeast Quarter of Section 22, Township 41 North, Range 11, East of the Third Principal Meridian, as per Plat recorded in the Office of the Cook County Recorder of Deeds, on December 17, 1919 as Document 6696216, lying East of a line drawn 362.98 feet West of and parallel with the East line of said lot and South of the North line of said Section 22 in Cook County, Illinois, except that part falling in streets and highways, if any. WHEREAS, Petitioner, seeks to rezone the Subject Property which is presently zoned and classified within two zoning districts (P-1 Off-Street Parking District and B-3 Business Retail and Service District) to place all of the Subject Property in the B-3 Business Retail and Service District; and WHEREAS, a public hearing was held on the rezoning request (designated as Case No. ZBA-70-Z-85) before the Zoning Board of Appeals of the Village of Mount Prospect on the 21st day of November, 1985, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 5th day of November, 1985; and WHEREAS, the Zoning Board of Appeals has submitted its finding and recommendation in favor of granting the subject rezoning to the President and Board of Trustees of the Village of Mount Prospect, and the President and Board of Trustees of the Village have given further consideration to the rezoning request and have determined that the same satisfies the standards set forth in Section 14.805 of Article VIII of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of the Village to grant the request for rezoning, upon the condition that the Petitioner install additional landscaping within the Subject Property as approved by the Village, and further redesign traffic flow and sizes of parking stalls, and reduce the size of access on Algonquin and Dempster, and provide an enclosure for trash receptacles and identify loading areas within the Subject Property. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the rezoning of that portion thereof presently zoned and classified in the P-1 Off-Street Parking District to the B-3 Business Retail and Service District, upon accomplishment of the above mentioned conditions. SECTION THREE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
