ORDINANCE NO. 6027 AN ORDINANCE AMENDING ORDINANCE NO. 5642 GRANTING A CONDITIONAL USE PERMIT AND VARIATIONS FOR PROPERTY LOCATED AT 701 EAST PROSPECT AVENUE WHEREAS, the President and Board of Trustees of the Village of Mount Prospect, Illinois did adopt Ordinance No. 5642 entitled "An Ordinance Granting a Conditional Use Permit and Variations for the property located at 701 East Prospect Avenue ", at their regular meeting held August 7, 2007; and WHEREAS, Section 14.504.E of the Village Code of Mount Prospect states that the Village Board shall consider the Planned Unit Development subject to revocation if construction falls more than one year behind the schedule filed with the final plan, or exceeds five (5) years; and WHEREAS, the Petitioner has been unable to construct the 12 -unit rowhome project due to the national real estate downturn and has requested that the Village Board approve a 30 -month extension of time to complete construction; and WHEREAS, the President and Board of Trustees find that it is in the best interests of the Village to permit the extension requested by Petitioner. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS ACTING IN THE EXERCISE OF THEIR HOME RULE POWERS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: Ordinance No. 5642 is hereby amended to extend the approval date of the Conditional Use Permit and Variations, as adopted by Ordinance No. 5642, from August 7, 2007 to February 7, 2010 such that construction must be completed on or before February 7, 2015. SECTION THREE This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
