Published in pamphlet form by authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 20th day of November , 1985. 3103V/13 ORDINANCE NO.3579 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 1804 SOUTH ELMHURST IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS ROAD WHEREAS, Northwest Partners has filed an application for variation with respect to property commonly known as 1804 South Elmhurst Road in the Village of Mount Prospect, Illinois (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: North 760.96 feet as measured along the West and East lines of the East 20 acres of the Northeast quarter of the Southeast quarter of Section 23, Township 41 North, Range 11 East of the Third Principal Meridian (except the North 300 feet of the East 450 feet thereof) also (except the East 50 feet of the South 500.96 feet of said North 760.96 feet thereof used for Elmhurst Road) also excepting that portion of Algonquin Road used for public purposes, all in Cook County, Illinois. WHEREAS, Petitioner, seeks a variation from the following provisions of Chapter 14 of the village Code of Mount Prospect, Illinois, to allow a 10 foot deep front and rear yard rather than the 30 foot front yard and 20 foot rear yard otherwise required by Sections 14.2002.A and 14.2002.C and to allow a reduction in the number and size of loading space to 8 rather than the 9 spaces required by Section 14.2005.B; all said Sections being in Article XX of Chapter 14; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA-66-V-85) before the Zoning Board of Appeals of the Village of Mount Prospect on the 24th day of October, 1985, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 8th day of October, 1985; and WHE~AS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect to allow the requested variation, and the President and Board of Trustees of the Village have given further consideration to the variation request and have determined that the same satisfies the standards set forth in Section 14.605 of Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of the Village to grant the request for variation. NOW THEREFORE, BE IT ORDAI~ED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTiON ~fO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the variation requested with respect to Sections 14.2002.A, 14.2002.C and 14.2005.B to allow front and rear yards of 10 feet in depth and 8 loading spaces (two being 10 feet by 45 feet in dimension and six being 10 feet by 20 feet in dimension). SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
