Published in pamphlet form by the authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 20th day of November , 1985 3103V ORDINANCE N0.~575 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 121 NORTH FAIRVIEW IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Mr. John Bunce has filed an application for variation with respect to property commonlY known as 121 North Fairview in the Village of Mount Prospect, Illinois (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: Lot 22 in Block 19 in Prospect Manor, being a Subdivision of part of the South three quarters of the West half of the West half of Section 34, Township 42 North, Range 12 East of the Third Principal Meridian, in Cook County, Illinois. WHEREAS, Petitioner, seeks a variation from the following provisions of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the construction of the single family residence to be built on the Subject Property having a width of 49.24' and an exterior side yard of 17.5' on a corner lot within a zoning district requiring buildable width of 75' pursuant to Section 14.11~A.1 and an exterior side yard of 20' pursuant to Section 14.1102.B.2; both Sections being in Article XI of said Chapter 14; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA-55-V-85) before the Zoning Board of Appeals of the Village of Mount Prospect on the 10th day of October, 1985, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 23rd day of September, 1985; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect to allow the requested variation, and the President and Board of Trustees of the Village have given further consideration to the variation request and have determined that the same satisfies the standards set forth in Section 14.605 of Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of the Village to grant the request for variation. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the village of Mount Prospect hereby grant to the Subject Property the variation requested with respect to Section 14.1101.A.1 and 14.1102.B.2 of Article XI of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the construction of a single family residence on the Lot containing 49.24' in width (6,294 square feet of area) and having an exterior side yard of 17.5' SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
