Published in pamphlet form by the authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 6th day of November , 1985 3041/4 ORDINANCE NO. 3574 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 223 SOUTH EMERSON STREET IN THE VILLAGE OF MOUNT PROSPECT~ ILLINOIS WHEREAS, Mr. and Mrs. John R. Kennedy have filed an application for variation with respect to property commonly known as 223 South Emerson Street in the Village of Mount Prospect, Illinois (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: Lot 39 in Block 121 in Waldmar Krauses Addition in Mount Prospect, in the East half of the Northwest quarter of Section 12 Township 42 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois according to the plat thereof registered in the Office of the Registrar of Titles in Cook County, Illinois on January 15, 1912 as Document No. 22935. WHEREAS, Petitioner, seeks a variation from the following provisions of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the construction of a single family residence to be built on the Subject Property having a width of 50 feet and 7,850 square feet of lot area within a zoning district requiring buildable areas to contain 65 feet in width and 8,125 square feet in area pursuant to Section 14.1101.A.1 and further construct said residence to a maximum height of 31 feet rather than the 24 foot height maximum established by Section i4.1101.A.2; both Sections being in Article XI of Chapter 14; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA-51-V-85) before the Zoning Board of Appeals of the Village of Mount Prospect on the 26th day of September, 1985, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 9th day of September, 1985; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect to allow the requested variation, and the President and Board of Trustees of the Village have given further consideration to the variation request and have determined that the same satisfies the standards set forth in Section 14.605 of Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of the Village to grant the request for variation. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the variation requested with respect to Section 14.1101.A.1 and 14.1101.A.2, of Article XI of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the construction of a single family residence on a lot containing 50 feet in width and 7,850 square feet of lot area and to allow said structure to be built to a height of 31 feet. SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
