Published in pamphlet form by the authority of the corporate authorities of the Village of Mount Prospect, Illinois. the 6th day of November 1985 3005V ORDINANCE NO. 3572 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 207 CATINO COURT IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Mr. Thomas J. Daley has filed an application for variation with respect to property commonly known as 207 Catino Court in the Village of Mount Prospect, Illinois (the "Subject Property"): a~d WHEREAS, the Subject Property is described as follows: Lot 6 in Westgate Garden Subdivision, being a Subdivision of part of the Northeast quarter of the Southwest quarter of Section 35, Township 42 North, Range 11 East of the Third Principal Meridian, according to the plat thereof registered in the Office of the Registrar of Titles of Cook County, Illinois on July 27, 1976 as Document No. 2884063. WHEREAS, Petitioner, seeks a variation from the following provisions of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the construction of a new two flat residence structure on the Premises, increasing the permitted floor area ratio to .45 rather than .35 as provided in Section 14.1303 of Article XIII of said Chapter 14 and to allow two of the required four off-street parking spaces to be located on the front yard in variation to the requirements of Section 14.1302.A: and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA-44-V-85) before the Zoning Board of Appeals of the Village of Mount Prospect on the 5th day of September, 1985, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 16th day of August, 1985; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect to allow the requested variations, and the President and Board of Trustees of the Village have given further consideration to the variation requests and have determined that the same satisfy the standards set forth in Section 14.605 of Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of the Village to grant the request for variation. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the variations request with respect to Sections 14.1303 and 14.1302.A, of Article XIII of chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the construction of a two-flat residence tructure located on the Subject Property having an increased floor area ratio of .45 with two of the four required parking spaces to be located in the front yard area. SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
