Published in pamphlet form by the authority of the corporate authorities of the Village of Mount Prospect, Illinois, the l~th day of October , 1985 2901S/7 ORDINANCE NO.3571 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 605 ST. CECILIA DRIVE IN THE VILLAGE OF MOUNT PROSPECT~ ILLINOIS WHEREAS, Mr. Fred Potenza has filed an application for variation with respect to property commonly known as 605 St. Cecilia Drive in the Village of Mount Prospect, Illinois (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: Lot 42 in St. Cecilia's Subdivision, being a Resubdivision of Lot 2 and parts of Lots 3 and 6 in Meier Brothers Subdivision, being a Subdivision of parts of Sections 10 and 15, Township 42 North, Range 11 East of the Third Principal Meridian, in Cook County, Illinois, according to the plat thereof registered in the office of the Registrar of Titles in Cook County, Illinois, on December 26, 1978, as Document No. 3067889. WHEREAS, Petitioner, seeks a variation from the following provisions of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow an open roof structure over the rear yard patio be to be located fifteen (15') feet from the rear property line rather than the twenty-five (25') feet rear yard setback required by Section 14.1102.C of Article XI of said Chapter 14; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA-47-V-85) before the Zoning Board of Appeals of the Village of Mount Prospect on the 5th day of September, 1985, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 16th day of August, 1985; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect to allow the requested variation, and the President and Board of Trustees of the Village have given further consideration to the variation request and have determined that the same satisfies the standards set forth in Section 14.605 of Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of the Village to grant the request for variation. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOISt AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the variation requested with respect to Section 14.1102.C, of Article XI of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the construction of a roof over an open patio area to fall BA 4385,- , 2 of 2 within fifteen (15') feet of the rear property line of the Subject Property. SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
