Published in pamphlet form by the authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 16th day of October , 1985 2901S/4 ORDINANCE N0.3570 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 411 CRAIG COURT IN THE VILLAGE OF MOUNT PROSPECT~ ILLINOIS WHEREAS, Mr. Donald J. Craig has filed an application for variation with respect to property commonly known as 411 Craig Court in the Village of Mount Prospect, Illinois (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: Lot 8 in Lincoln Circle Subdivision, being a Subdivision of the North 3/4 of the Northeast 1/4 of the Northeast 1/4 of the Southwest 1/4 of Section 10, (except the East 300 feet thereof), Township 41 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois. WHEREAS, Petitioner, seeks a variation from the following provisions of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the construction of an oversized garage containing six hundred sixteen (616) square feet in area instead of six hundred (600) square feet allowed by Section 14.102.B.4 of Article I of said Chapter 14; to allow a twenty-eight (28') foot wide driveway instead of the eighteen (18') foot drive required by Section 14.116.C of Article I of said Chapter 14; and to allow for a three car capacity garage rather than a two car garage as provided by Section 14.1101.B.3 of Article XI of said Chapter 14; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA-46-V-85) before the Zoning Board of Appeals of the Village of Mount Prospect on the 5th day of September, 1985, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 16th day of August, 1985; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect to allow the requested variation, subject to retaining the driveway width at eighteen feet (18') at the property line except to allow a tapering thereof to twenty-eight feet (28') in width at the garage area, and the President and Board of Trustees of the Village have given further consideration to the variation request and have determined that the same satisfies the standards set forth in Section 14.605 of Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interests of the Village to grant the request for variation upon the further condition that no part of the driveway be located within five (5') feet of an existing fire hydrant situated in the right-of-way. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. "~ 46-V-85 2 of 2 SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the variation requested with respect to Section 14.102.B.4, Section 14.116.C, and Section 14.1101.B.3 of Articles I and X of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the construction of an oversized garage having an area of six hundred sixteen (616') square feet with the capacity to house three cars· and tapering from a width of eighteen feet (18') at the ~roperty line to a width of twenty-eight feet (28') at the garage area of the Subject Property, provided that no part of the driveway shall fall within five feet (5') of the existing fire hydrant in the right-of-way. SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
