Published in pamphlet form by the authority Of the corporate authorities of the Village of Mount Prospect, Illinois, the 16th day of October , 1985 2901S ORDINANCE No.3569 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 903 SOUTH WE-GO TRAIL IN THE VILLAGE OF MOUNT PROSPECT~ ILLINOIS WHEREAS, Mr. and Mrs. William G. Watters have filed an application for variation with respect to property commonly known as 903 South We-Go Trail in the Village of Mount Prospect, Illinois (the "subject Property"); and WHEREAS, the Subject Property is described as follows: Lot 34 in Schaville and Knuth, Inc. "Sunset Heights", a Subdivision of the East 110 feet (as measured on the North lin~ of that part of the East half of the Northwest Quarter of Section 14, Township 41 North, Range 11 East of the Third Principal Meridian, lying North of the North line of Golf Road; also that part of the West half of the Northeast Quarter (except the East 7.38 chains thereof as measured on the North line thereof) of Section 14 aforesaid, lying North of the North line of Golf Road, in Cook County, Ilinois. WHEREAS, Petitioner, seeks a variation from the following provisions of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow a new room addition to be to be located six (6') .feet from the side property line rather than the six and one-half (6.5') feet required by Section 14.1102.B.1 of Article XI of said Chapter 14; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA-45-V-85) before the Zoning Board of Appeals of the Village of Mount Prospect on the 5th day of September, 1985, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 16th day of August, 1985; and WHEREAS, the zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect to allow the requested variation, and the President and Board of Trustees of the Village have given further consideration to the variation request and have determined that the same satisfies the standards set forth in Section 14.605 of Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of the Village to grant the request for variation. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hersby grant to the Subject Property the variation requested with respect to Section 14.1102.B.1, of Article BA 45-V-85, 2 of 2 XI of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the construction of a new room addition ball wall to fall within six feet (8') of the side property line of the Subject Property. SECTION THREE: Except for the variation granted herein, all other applicable village of Mount Prospect Ordinances and regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
