Published in pamphlet form by the authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 2nd day of October , 1985 2901S/10 ORDINANCE NO. 3568 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 1414 CHESTNUT DRIVE IN THE VILLAGE OF MOUNT PROSPECT~ ILLINOIS WHEREAS, Mr. and Mrs. Kenneth Schmidt have filed an application for variation with respect to property commonly known as 1414 Chestnut Drive in the Village of Mount Prospect, Illinois (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: Lot 161 in Elk Ridge Villa Unit No. 3, being a Subdivision in the Southwest 1/4 of Section 14 and in the Southeast 1/4 of Section 15, all in Township 41 North, Range 11 East of the Third Principal Meridian, in Cook County, Illinois. WHEREAS, Petitioner, seeks a variation from the following provisions of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow a second floor to be constructed unto the existing residence premises thus increasing the permitted floor area ratio to .35 rather than .30 as provided in Section 14.1203 of Article XII of said Chapter 14; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA-48-V-85) before the Zoning Board of Appeals of the Village of Mount Prospect on the 5th day of September, 1985, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 16th day of August, 1985; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect to allow the requested variation, and the President and Board of Trustees of the Village have given further consideration to the variation request and have determined that the same satisfies the standards set forth in Section 14.605 of Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of the Village to grant the request for variation. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the variation requested with respect to Section 14.1203, of Article XII of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the construction of a second floor to the residence structure located on the Subject Property having an increased floor area ratio of .35. BA~V 85~ 2 of 2 SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: This Ordinance shall be in full force and effect frOm and after its passage, approval and publication in pamphlet form in the manner provided by law.
