HomeMy WebLinkAboutOrd 3565 09/17/19852929V/4 ORDINANCE NO. 3565 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 205 SOUTH PINE STREET IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Carol H. Tortorello has filed an application for variation with respect to property commonly known as 205 South Pine Street in the Village of Mount Prospect, Illinois (the"Subject Property"); and WHEREAS, the Subject Property is described as follows: Lot 34 in the South 10 feet of Lot 33 in Busse's Resubdivision of Lots 1 to 6 inclusive of the Resubdivision of Lots 1 to 6 inclusive in Block 4; also Lots 2 and 3 in Block 5; all of Block 6~; Lots 13 to 24 inclusive in Block 7; Lots 17 to 20 in Block 8 all in Meier's addition to Mount Prospect, a ~ubdivision of the Northwest quarter of Section 12, Township 41 North, Range 11 East of the Third Principal Meridian in Cook County, Illinois. WHEREAS, Petitioner, seeks a variation from the following provisions of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the construction of a detached three car garage rather than a two car garage as provided in Section 14.1101.B.3 of Article XI, to allow said garage to consist of 704 square feet instead of 600 square feet of area as provided by Section 14.102.B.4 of Article I, and to allow said garage to be located two (2') feet from the side property line rather than the five (5') feet required by Section 14.102.B.2 of Article I of said Chapter 14; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA-41-V-85) before the Zoning Board of Appeals of the Village of ~ount Prospect on the 22nd day of August, 1985, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 5th day of August, 1985; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of ~iount Prospect to allow the requested variation, upon condition that no additional accessory structures would be built on the Subject Property such as a garden or tool shed, and no home occupation would be operated from the garage, and the garage would not be used for storage or warehousing of any merchandise or for any vehicle restoration purposes; and the President and Board of Trustees of said Village have given further consideration to the variation request and have determined that the same satisfies the standards set forth in Section 14.605 of Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of the Village to grant the request for variation upon the conditions recommended by the Zoning Board of Appeals. NOW THEREFORE, TRUSTEES OF THE VILLAGE FOLLOWS: BE IT ORDAINED BY THE PRESIDENT AND BOARD OF OF MOUNT PROSPECT, COOK COUNTY, ILLI~OIS, AS SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the variation requested with respect'to Sections 14.1101.B.3, of Article XI, and 14.102.B.4, and 14.102.B.2 of Article I of Chapter 14 of the Village Code of Mount Prospect, Illinois, to to allow the construction of a three car garage containing 704 square feet of garage area and located two feet from the side property line of the Subject Property, upon condition that no additional accessory buildings or structures such as garden or tool shed structures shall be located on the Subject Property, no home occupation shall be operated from the garage and the garage shall not be used for storage or warehousing of any merchandise or for vehicle restoration purposes. SECTION THREE: Except for the variations granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
