RDINANCE NO. 3609 AN ORDINANCE PROHIBITING THE DISCHARGE OF SANITARY AND INDUSTRIAL WASTE INTO ANY STORM SEWER OR DRAINAGE FACILITY CONSTRUCTED AS A PART OF THE U.S. ROUTE 45 IMPROVEMENT WHEREAS, the State of Illinois, acting by and through its Department of Transportation, is desirous of improving the U.S. Route 45 between Willow Road and IL Route 58 in the Village of Mount Prospect; and the City of Des Plaines; and WHEREAS, said project includes the installation of storm sewers and drainage facilities; and WHEREAS, a portion of the project runs through the Village of Mount Prospect including the installation of storm drains and drainage facilities. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: No person, firm, corporation or other entity shall dischawge any sanitary waste or industrial waste water into any storm sewer or drainage facility constructed as part of the U.S. Route 45 improvement, said limits of improvement being between Willow Road and IL Route 58, and a portion of which passes through the Village of Mount Prospect. SECTION TWO: The Village Clerk of the Village of Mount Prospect is authorized and directed to attach a copy of this Ordinance to the agreement dated , 19 , by and between the State of Illinois and the Village of Moun~--~-F'6'spect, relative to the U.S. Route 45 improvement. SECTION THREE: This Ordinance shall be in full force and effect from ~d after its passage, approval and publication in pamphlet form in the manner provided by law. Route 124 State Section: 3219WRS(80) Cook County The Honorable Ms. Carolyn H. Krause Mayor Village of Mount Prospect 100 South Emerson Street Mount Prospect, Illinois 60056 Dear Hayor Krause: The State is desirous of improving approximately 13,400 lineal feet of U.S~ Route 45 (also known as Des Rtaines River Road/Lee Street) from Willow Road to Illinois Route 58 (Golf Road) in the Village of Mount ProsPect and the City of Des Rlaines, Cook County, Illinois [F.A.R. Route 124, U.S. Route 45, State Section: ~219WRS(80)] by making the following improvements: A. U.S. Route 45 - from Willow Road to Illinois'Route 58 (with omission from Station 255+94 to Station 280+25): Roadway widening to 48' edge to edge to provide two 12' through lanes in each direction complete with curb and gutter, upgrading of storm sewer system, channelizing various intersections and complete resurfacing throughout; B. U.S~ Route 45 e Central Road: Relocation of loop detectors and roadway resurfacing; C. U.S. Route 45 ® Euclid Avenue: Relocation of loop detectors and roadway resurfacing; U.S. Route 45 at Camp McDonald Road: Intersection channelization to provide one 12' left turn lane on the south leg of U.S. Route 45 and to provide one 12' left turn lane on the west leg of Camp McDonald Road, installation of new traffic signals; and by performing all other work necessary to complete the improvement in accordance with the approved plans and specifications. In order that the State and Village may benefit by this proposed improvement, we are requesting concurrence with the following: The State will make all surveys, obtain all necessary rights of way, prepare plans and specifications, receive bids and award the contract, furnish engineering inspection during construction and cause the improvement to be built in accordance with the plans, specifications and contract. The State will pay for all surveys, right of way, construction and engineering costs. The Honorable Ms. Carolyn H. Krause ' Page 2 Upon completion of the improvement: The State will maintain along U.S. Route 45 within the limits of the improvement, the median, the through traffic lanes, the left-turn and/or right-turn lanes and the curb and gutter or shoulders and ditches adjacent to the traffic lanes. The State will be responsible for maintenance of lane line and median line markings. The Village will maintain along U.S. Route 45 within the limits of the improvement (within the Village limits) those portions of the improvement not maintained by the State, including sidewalks, manholes, catch basins, parkways, storm sewers, utilities and appurtenances. The Cook County Highway Department will continue to maintain lO0~ of Camp McDonald Road· Upon acceptance by the State of the new traffic signal installation, the financial responsibility for the maintenance and electrical energy for the operation of the signals shall be proportioned as follows: Intersection Level of Maintenance Electrical ~nce Energy U;S; Route 45 e Camp McDonald Road State Share . . . O~ 100~ It is agreed that the actual signal maintenance will be performed by the State either with its own forces or through an ongoing contractual agreement. It is further agreed that the signals shall be maintained to at least the Level of Maintenance shown above and specified in the attached Exhibit B made a part hereof. It is further agreed that upon acceptance by the State of the new traffic signal installation(s) included herein, the responsibility for maintenance and energy outlined above shall become a part of the Master Agreement executed by the State and Village of March 3, 1982. Upon acceptance by the State of the work included herein on existing signals, the responsibility for maintenance and energy shall continue to be as outlined in the aforementioned Master Agreement. The State agrees to make arrangements with the local power company to furnish the electrical energy for the operation of the traffic signals. The Village agrees to pay its proportionate share of this cost as billed by the local power company. The Honorable Ms. Carolyn H. Krause Page ~ The State will cause private utilities to be relocated at no expense to the State or Village. Where a municipal utility has bean installed (1) on right of way acquired by the Illinois Department of Transportation or (2) within defined limits of a route the Illinois Department of Transportation has accepted for maintenance responsibilities, subsequent to the date of such acceptance, the municipality will bear all utility relocation or adjustment costs made necessary by the construction of this improvement. The State and Village on March ~¢ 1982 entered into a Master Agreement covering maintenance and energy responsibilities for all signalized intersections along State highways in the Village, Exhibit A which is attached hereto as Exhibit A. Upon acceptance by the State of the traffic signal work included herein, revisions shall be made in the Master Agreement for the intersections of U.S. Route 45 and Camp McDonald Road. Attached hereto and made a material part hereof is "Revised Exhibit A" which contains a comprehensive listing of all signals covered by the Master Agreement and reflects the changes described hereinabove. A copy of the aforementioned "Revised Exhibit A" is attached hereto as Exhibit B. 5. The Village will adopt and put into effect the following ordinances: Rarking will be prohibited within that portion of the improvement falling within the Village limits of the improvement. be Storm sewer, sanitary sewer and industrial waste water connections into any drainage facility constructed as part of the improvement are prohibited. c. Encroachments will be prohibited. d. Plan approval (letter will be satisfactory). This Letter of Understanding shall become null and void in the event the contract covering the construction is not awarded by Suly l, 1788. he Honorable Ns. Carolyn H. Krause Page 4 Approval of this Letter of Understanding shall be considered as concurrence with and acceptance of the terms contained herein and shall be binding upon and inure to the benefit of the parties hereto, their successors and assigns. This letter of understanding is agreed to as amended by the attached letter regarding maintenance of utilities.
