Published in pamphlet form by the authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 5th day of February , 1986 ORDINANCE NO. 3606 AN ORDINANCE AUTHORIZING THE SALE OF CERTAIN REAL ESTATE OWNED BY THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, the Village oF Mount Prospect, Illinois owns the following described real property: Lots 1, 2 and 3 in Gregory's Resubdivision of Lot 33 (except the West 0.78 feet thereof), tot 34 and Lot 35 in Northwest Hills Country Club Subdivision, being a Subdivision of part of the Southwest Quarter of Section 11, Township 41 North, Range 11 East of the Third Principal Meridian in Cook County, Illinois. Also, the West half of South We-Go lrail East of and adjoining tot 35 aforesaid lying South of the North line of tot 35 extended East. which property is commonly known as 1100, 1010 and 1008 West Lonnquist Boulevard, Mount Rrospect, Illinois and is currently vacant and consists of three contiguous lots each of which contains sufficient area and frontage, and is zoned and classified for development for single family residence purposes; and WHEREAS, the President and Board of Trustees of this Village have determined that it is no longer necessary, appro- priate or in the best interest of the Village that it retain title to the said real estate; and that said real estate is not required for the use of, or profitable to the Village; and WHEREAS, it is the further determination of the Rresident and 8card of Trustees of the village that the best interests of the Village and its residents will be served by offering the subject real estate for sale pursuant to the advertisement for bids thereon as provided for in Section 8.514 of the Village Code of Mount Rrospest, Illinois. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND 80ARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSRECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The President and Board of Trustees of this Village to herein adopt as facts the recitals hereinabove set form. SECTION TWO: The Village owned real estate hereinabove described and determined herein to be surplus property and no longer necessary, appropriate or required for municipal use, shall be sold pursuant to the publication of a notice of proposal to sell, as hereinafter set forth; said notice to be published once each week for three successive weeks in ~h_e_ Daily Herald, a newspaper published daily in the Village of Mount Prospect, Illinois. The First publication for bids shall not be less than thirty (30) days before the date provided in the notice for the opening of bids For the sale of subject real estate, and all such bids shall be acted upon at a regular meeting of the President end Board of Trustees of this Village as provided for in Section 8.514 of the Village code of Mount Prospect, Illinois. SECTION THREE: The Village Clerk is hereby authorized and directed to publish the notice referred to in Section 2 hereof, in the following Form: "NOTICE OF SALE OF CERTAIN RESIDENTIALLY ZONED REAL ESTATE OWNED BY THE VILLAGE OF MOUNT PROSPECT, AND INVITATION TO BID THEREON. PLEASE TAKE NOTICE THAT the President and Board of Trustees of the Village of Mount Prospect, Illinois will receive sealed bids for the purchase, under tbe successful bid, of the fee simple interest in the following described real estate: Lots 1, 2 and 3 in Gregory's Resub- division of Lot 33 (except the West 0.78 feet thereof), Lot 34 and Lot 35 in Northwest Hills Country Club Sub- division, being a Subdivision of part of the Southwest Quarter of Section 11, Township 41 North, Range 11 East of the Third Principal Heridian in Cook County, Illinois. Also, the West half of South We-Go Trail East of and adjoining Lot 35 aforesaid lying South o¢ the North line of Lot 35 extended East. which property is commonly knowo as ~006 , 1004 and 1002 West Lonnquist Boulevard, Mount Prospect, Illinois, and is vacant. Said property consists of three contiguous lots, containing sufficient lot area and frontage and zoned and classified for development for single family residence purposes. Bidders shall bid on the purchase of each lot separately. No bid on lots 1 and 2 shall be less than $43,000, and no bid on lot 3 shall be less than $47,000. Bids are hereby invited and will be received by the Village Manager at the Village Hall, 100 South Emerson Street, Mount Prospect, Illinois, during normal business hours, Monday through Friday and until 10:00 a.m. CST on the loth day of March, 1986. Bids shall be in writing and shall be in sealed envelopes addressed to Terrance L. 8urghard, Village Manager, Village of Mount Prospect, 100 South Emerson Street, Mount Prospect, Illinois, and shall bear the legend "Proposal for the Sale of Vacant Residential Lots" and shall also have the name and the address of the bidder printed thereon. All bids shall be accompanied by a cashiers or certi- fied bid check, made payable to the Village of Mount Prospect, in the amount of ten (10%) percent of the total bid price, which payment shall guarantee that the successful bidder will enter into a contract fcc the purchase of the property in question and complete the same in accordance with the amount of his bid. The bid check of the successful bidder or bidders shall be applied as an earnest money deposit on execution of the contract as herein- after described for tile sale of the subject real estate. All bids received will be publicly opened and read aloud at 10:00 a.m. CST in the Trustees' Room, second (2nd) Floor of Village Hall, and shall thereafter be submitted for action by the President and Board of Trustees at their regular meeting on the 18th day of March, 1986; said meeting to commence at 8:00 p.m. CST. A contract may be awarded to the bidder who submits the highest bid for each lot to be sold or to that bidder whose bid is Found to be in the best interests of the Village by a vote of three-fourths (3/4) of the Corporate Authorities of the Village. The Village reserves the right to reject any and all bids and to ~aive any informalities or irregularities in the bidding. The President of the Board of Trustees further reserves the right to review and study any and all bids and to make an award within thirty (30) days following the bid opening. The successful bidder shall execute a contract substantially in the farm, terms and provisions of the contract adopted by Ord±namce ¢3606, copies of which are available for examination by bidders at the office of the Village Clerk. BY ORDER OF THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, ILLINOIS. Village Clerk, Mount Prospect, Illinois SECTION FOUR: The subject real estate shall be sold pursuant to a Contract substantially in the form, and containing the terms and provisions as set forth in the Real Estate Sale Contract, a copy of which is attached hereto and made a part of this Ordinance by reference. There shall be added to said Contract the name of the successful bidder-purchaser, the amount of the purchase price and the amount of ths earnest money deposit, and such other further provisions as are deemed necessary pursuant to the bid proposal. The Village President and the Village Clerk ars hereby authorized and directed to execute said Contract on behalf of the Village and to execute and attest to such other documents as may be necessary to the conveyance of the subject real estate herein authorized. SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in accordance with law.
