Published in pamphlet form by the authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 5th day of February , 1986 3333V ORDINANCE NO. 3605 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 1101 WEST LINCOLN STREET IN~ THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Mr. Kenneth Marchini has filed an application for variation with respect to property commonly known as the 1101 West Lincoln Street in the Village of Mount Prospect, Illinois (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: Lots 7 and 8 in Northwest Hills Country, Club being a Subdivision of part of the Southwest quarter of Section 11, Township 41 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois. WHEREAS, Petitioner, seeks a variation from the provisions of Section 14.102.B.4 of Article I of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the construction of an attached garage containing an area of 636 square feet rather than the maximum permitted area of 600 square feet for the purpose of housing motor vehicles as well as bicycles and miscellaneous garden equipment; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA-l-V-86) before the Zoning Board of Appeals of the Village of Mount Prospect on the 9th day of January, 1986, pursuant to due and proper notice thereof published in the Mount Prpspect Herald on the 24th day of December, 1985; and WHEREAS, the Zoning Board of Appeals has submitted its finding and recommendation to the President and Board of Trustees of the Village of Mount Prospect, in favor of granting the subject variation to allow the garage to be erected provided that no other accessory buildings will be located on the Subject Property, and the President and Board of Trustees of the Village have given further consideration to the variation request and have determined that the same satisfies the standards set forth in Section 14.605 of Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of the Village to grant the request for variation, provided that no additional accesory buildings are located on the Subject Property. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the variation requested with respect to Section 14.102.B.4 of Article I of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the construction of an attached garage containing an area of 636 square feet, upon the condition that no additional accessory buildings shall be located on the Subject Property. SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
