HomeMy WebLinkAbout07/11/1995 COW minutes MINUTES COMMITTEE OF THE WHOLE JULY tl, 1995 CALL TO ORDER Mayor Gerald Farley celled the meeting to order at 7.33 p m Present at the meeting were Mayor Gerald L Farley, Trustees George Clowes, R~chard Hendncks, Paul Hoefert, Michaele Skowron, and Irvana Wilks Absent from the meeting was Trustee Timothy Corcoran Also present were V~llage Manager M~chael Janoms, Assistant Village Manager David Strahl and Deputy Pohce Chief Thomas Daley II MINUTES Acceptance of the Minutes of June 27, 1995 Mobon made by Trustee Wilks and seconded by Trustee Skowron to approve the Minutes Minutes were approved II1. CITIZENS TO BE HEARD Don Sahaglan of 400 Milburn and Fred Stelnmiller of 220 S. I-Oka, spoke They requested the Village Board consider a prohlb~tion on construction work ~n residential areas on Sunday and also reduce the number of hours per day which construction may take place in resldenbal areas ,- Mayor Farley asked that the Student Resource Officer d~scuss~on be placed ahead of the Age and Gang Related Offense Ordinance discussion due to members of D~stnct 26 hawng to leave for another meeting IV. STUDENT RESOURCE OFFICER (SRO) DISCUSSION In early 1995, the V~llage Board first considered the concept of a Student Resource Officer (SRO) Program for the Village's junior high schools and m~ddle schools The SRO concept is modeled after the V~llage's ve~ successful and long-standing School Counselor Program In place w~th High School Dlstnct 214 and Prospect H~gh School The topic was d~scussed at two Committee of the Whole meetings and a Saturday ~'~ meeting of an Ad Hoc group made up of various elected and administrative representatives from the Village and Elementary School D~stncts operabng w~thln the Village Due to t~me constraints imposed by the Federal Crime B~II and the Board's desire to take advantage of funding available for community policing projects, the SRO concept was tabled in favor of ~mplement~ng a community-wide Problem-Solwng Pohce Umt These two Officers will operate throughout the V~llage on an as-needed bas~s to address spemfic problems ~n vanous parts of our commumty In making the decision to pursue the Problem-Solwng Police Umt, the Board expressed a strong desire to conbnue d~scuss~ng the concept of an SRO Program for the lumor high schools and m~ddle schools Elementary School D~stnct 26 also expressed a very strong desire to enter into a partnership w~th the Village for the ~mplementabon of a p~lot SRO Program The idea of a p~lot program was endorsed by the other Mount Prospect Elementary School D~stncts At the May 23 Committee of the Whole meeting, the Village Board considered entenng ~nto a pilot program w~th School D~stnct 26 After extensive discussion -- including d~alogue w~th D~stnct 26 representatives at the meeting - Village staff was d~rected to prepare appropnate documents that would lead to the implementat~on of a SRO Program m brae for the 1995/1996 school year Mayor Farley stated that at th~s point he would request that the Village Board members review the draft agreement which has been presented and be prepared to direct staff to move forward w~th the agreement as drafted and determine whether any recommended changes are requested Don Kellen, Director of Support Sen/ices for School District 26, spoke The Dlstnct Is very will~ng to cooperate by making a two-three year corr~rnltment for the full rewew of th~s program He feels that th~s ~s an excellent opportunity for the School Distnct and the V~llage to work together to establish a relationship with the students in order to make the students better c~flzens in the long run General discussion w~th the Village Board members followed Among the ~tems d~scussed was the concern of whether the officer would be able to represent adequately their role as a law enforcer and still have the responsibility to testify in court proceedings, if necessary. Some concern was expressed whether the ambitious brae frame would be fulfilled at this time for the upcoming school year Trustee Clowes expressed opposition to the Student Resource Officer Program because he as concerned about putting Police Officers an the junior h~gh and middle schools at th~s bme He also felt the parents should be more instrumental ~n enfor~ng school rules and the relationship should be strengthened between the parents, students, and school d~stnct General consensus of the Village Board was to proceed as outlined in the schedule which was presented in the draft. Staffwas requested to bring forward the measure for final approval as soon as possible. Declaration of approval by Trustees is as follows: Elected Officials which support the program are Trustees Skowron, Hoefert, Wilks and Mayor Farley. Trustees which do not support ~e program are Trustees Clowas and Hendricks. AGE AND GANG RELATED OFFENSES ORDINANCE As part of the drafting process for this ordinance, input was sought from all segments of the Village The School D~stncts, Park Distncts and L~brary have all received drafts of the proposed Ordinance and have been asked to comment on same Additionally, Teens and Parents for a Better Mount Prospect (TAP-Mount Prospect) have rewewed the proposed Ordinance A draft copy has also been forwarded to Attorney General James Ryan's office for has rewew and comment Generally the feedback has been very positive The Village Board undertook an initial rewew of the draft Ordinance at its May 23 Committee of the Whole meeting Follow-up consideration was delayed pending ~nput from TAP-Mount Prospect It ~s anbc~pated that the meeting and d~scuss~on tonight w~ll prowde staff w~th suffi~ent direction to undertake a "final" drafting of the Ordinance Mayor Farley stated that he would like the d~scuss~on focused on the ~nput from other organizations which had been prewously sohc~ted by Trustee Wilks The goal would be to have this Ordinance ready for ~mplementat~on by the start of the upcoming school year A couple of decisions that need to made pnor to the final drafting include whether to place the Ordinance as a single Code Secbon or maintain the relevant subjects ~n vanous areas of the Code as they currently are Trustee Wilks stated that many of the people that she talked to in sol~c~bng input for this Ordinance were extremely supportive and she would recommend following the TAP comments on their summary page which they have prowded to the V~llage Board as an a~d for d~scusslon 3 Trustee Clowes stated that he would hke to thank TAP for the comments and all the input which was summanzed ~n the outl~ne provided to the V~llage Board He stated that one of the important things that TAP promotes is the ability to allow) students to learn to make their own de~slons and feels the discussion surrounding the rewew of th~s ordinance ~s very ~mportant to that end General d~scuss~on followed m which the comments that were prowded by TAP m handout (spreadsheet) to the V~llage Board was d~scussed Underaqe dnnk~nq Consensus of the V~llage Board was to !nclude counseling as a sentencing option Frae Reducbon Consensus of the V~llage Board was to reduce the fine to $150 00 for ~mpoundment instead of $250 00 Unlawful Assembly of Undera,qe Persons Consensus of the Village Board was to request further review of these items and prepare alternative language for consideration Move Undera,qe Lanquaqe out of the Liquor Code Consensus of the V~llage Board was to reference the location of the Underage Dnnklng Language ~n the L~quor Code Undera,qe Dnnk~n,q/Dnwnq Consensus of the V~llage Board was to include the ---,, language of the State on the posted warning that must be d~splayed at hquor establishments Adult Dnnk~nq/Dnwnq Th~s item ~s not under consideration at th~s time Dnvmq w~thout valid L~cense & Insurance Th~s Item is not under consideration at this time Curfew Lanqua,qe Consensus of the Village Board was to add a section to define Fnday and to delete the permission shp language Truancy Consensus of the V~llage Board was to retain available language as outlined in the current ordinance ,, Spray Paint Consensus of the Village Board was to rewse the language to be more clear for persons under 21 Firearms Consensus of the V~llage Board was to retain the current code as is but clean up the language to be more clear Graffit~ Consensus of the V~llage Board was to retain the current code section but consider reduction from 14 to 7 days for removal t~me at a future time once additional ~nput from businesses IS received School Safe Zones Consensus of the V~llage Board was to accept as suggested but drop the t~me hm~t of safe zone only dunng school day Ganqs and Ganq Acbwt¥ Consensus of the V~llage Board was to use the State defimt~on of gangs and accept the language as proposed Gan(~ S~(~ns/Clothln,q Consensus of the V~llage Board was to accept the language which addressed altenng of clothing which ,s obwously altered to be considered gang clothing Also rewse the language to ~nclude such ~tems as tatoos and jewelry as gang-related alterabons Lo~tenn,q Consensus of the Vdlage Board was to define Io~tenng as a prohibited actlwty ~ntended to commit criminal act~wbes and follow the recommendabon of language prowded by TAP. Elm, spoke He stated that he ~s concerned about rights being hm~ted by the Trustees due to th~s Ordinance He felt that the proh~b~bon agalnst clothing alteration ~s a violation of the F~rst Amendment He also had concerns that there ~s not s~gmficant justification for the truancy and curfew language as proposed Jenny Van Winkle, student of Prospect High School, spoke She said that she ~s concerned about young persons getting into trouble just for being at an alcohol party when they are not aware of alcohol being served Consensus of the Village Board was to move forward with final revisions to the Ordinance for consideration by the full Board once the necessary revisions as outlined have been completed by the Village Attorney and Staff. 5 I.
