HomeMy WebLinkAbout09/26/1995 COW minutes MINUTES COMMITTEE OF THE WHOLE SEPTEMBER 26, 1995 CALL' TO ORDER Mayor Gerald Farley called the meeting to order at 7 32 p m Present at the meeting were Mayor Gerald L Farley, Trustees George Clowes, R~chard Hendncks, Paul Hoefert, M~chaele Skowron, and Irvana Wilks Absent from the meebng was Trustee T~mothy Corcoran Also present were Assistant V~llage Manager Dawd Strahl, Community Development D~rector Wilham Cooney, Planning Coordinator Daniel Ungerlelder, Pohce Chief Ronald Pavlock and Village Attorney Everette H~II ~ II MINUTES ~ Acceptance of the M~nutes of September 12, 1995 Motion made by Trustee Hoefert and Seconded by Trustee CIowes to approve the M~nutes M~nutes were accepted Trustee Hendncks abstained III CITIZENS TO BE HEARD None IV GUN REGULATION DISCUSSION .Mayor Gerald Farley introduced the Gun Regulation topic He stated th~s ~ssue is being brought up now due to the SportMart request to consider local gun regulabons ~n heu of the current Cook County Ordinance which affects gun sales SportMart requests the ab~hty to sell long guns only and ~s not requesbng handgun sales at th~s brae The Cook County Ordinance which became effecbve on September 1, 1994 states that retail gun estabhshments cannot be located w~th~n one-quarter m~le of schools or parks The Iocabon of the Mount Prospect SportMart store is w~th~n 800 feet of a small park ~n the Wedgewood area Greg Fix, SportMart General Counsel, spoke He stated that the s~te Prospect was under cons~derabon long before the County Ordinance was approved He stated that the V~llage of North R~vers~de previously approved an Ordinance which allows local gun hcensmg and control and would request the Board consider that Ordinance as a model for cons~derabon He stated that the sales of guns are related to hunting and sporting Chief Pavlock spoke He stated that there are currently no legal firearms hcensees ~n operabon w~th~n the Vdlage of Mount Prospect He stated there are three collectors which currently have I~censes from the ATF, however, collectors are prohibited from selling guns to the general public He stated h~s personal opinion ~as the Chief of Pohce ~s that he sees no reason that gun sales could not be banned at th~s bme since there are currently no hcensed gun dealers which would be affected at th~s t~me General comments of the Wllage Board members included the following ~tams Some members had concerns relabng to the exception of selling guns outside the radius which has been estabhshed by Cook County There seem to be very few areas w~thm Mount Prospect whmh do not fall w~thm the quarter mde radius at th~s t~me Therefore, ~n order to be consistent, the Board could consider proh~b~bng sales ~n all areas of town ~nstead of allowing them w~th~n very hmlted areas Other comments ~ncluded concern that the Vdlage should create local rules and may want to consider reducing the radius which has prewously been established by Cook County to a radius that is more consistent w~th the comm_umty of Mount Prospect relabve to locations of retad sales areas Members felt ~t was ~mportant to encourage proper firearms training whenever possible and encouraged retaders to assist ~n providing such training to patrons Mayor Farley polled the Board to determine each member's stance on the regulatory issue of gun sales within Mount Prospect. Mayor Farley stated he would support a total ban on 'the sale of guns and ammun~bon w~th~n the community Trustee Sk~)wron stated she W~uld support an Ordinance prohibiting sales Trustee Hendricks stated he would support the prohibition on sales Trustee Hoefert stated he would support a prohibition on sales w~th~n the community Trustee Wilks stated she feels that outright prohibition on sales ~s not necessary An Ordinance could contain the necessary regulations which some of the Board ' members stated they felt were important as part of any regulatory consideration Trustee Clowes stated he felt a local regulatory Ordinance should focus on the proper d~stance from schools and parks as estabhshed by the local elected body Consensus of the Village Board was to direct staff to draft an Ordinance prohibiting all gun and ammunition sales within the Village of Mount Prospect. V. CONTINUATION OF DISCUSSION OF RESIDENTIAL NEIGHBORHOOD ISSUES Si(m Re(~ulations in Ri.qhts-of-Way ~' Community Development Director Will,am Cooney prowded a general overview of the current s~gn regulabons relating to s~gnage w~thm the pubhc nght-ofTway He also prowded a general overview of the recommendations from the S~gn Rewew Board The Sign Review Board recommended permitting s~gns to be placed w~th~n the nght-of-way between 6 00 a m Saturday and 6 00 p m Sunday being hm~ted to Residential D~stncts only The V~llage staff would be requested to e~ther t~cket or remove any remaining s~gns as of Monday mormng General d~scuss~on of thee V~llage Board prowded the following ~nformabon Some members were concerned that there is a d~fference between commercial purpose s~gns,,and pubhc informatmn s~gns or non-profit type s~gns Such a d~fference should be considered m drafting any regulabons which affect s~gnage ~n the right-of-way Other members felt that Garage Sale s~gns should be permitted to be placed ~n the right-of-way beginning on Thursday, for example, due to many garage sale schedules Some members also voiced concern on Elecbon s~gns and their control Consensus of the V,llage Board was to direct 's~ff to outl,ne particular~issues which have been raised by the Village Board and refer thbse issues for further review and recommendation by the Sign Review Board. The issues to be considered Include definff~on of the types of signs which may be placed in the right-of-way, the determination of Election sign placement in the right-of-way, placement of signs in the right-of-way of residents who may be uncooperative of such placement vathin the right-of-way adJoining their home and determining a reasonable time frame which such signs may be permuted. Mary Kay Risler, One East Mdburn, spoke She stated that she hve's on the corner of Route 83 and Mdbbrn She stated she does not allow any s~gns to be placed ,~n her yard and would request the S~gn Review Board and the V~llage Board to consider all the ~ssues before passing any~regulabons Trustee Hoefert stated that he was concer, ned about equitable enforcement of such a S~gn Ordinance and ~t not be I~m~ted to complalnFfollow-ups, only, Hal Predovich, 200 East Lonnqu~st, spoke .He stated that as a representabve of the S~gn Rewew Board, they could reconsider their recommendations based on the ~nformat~on the Vdlage Board has prowded them th~s evemng Accessory Structures ~ .~ :. ,.. B~ll Cooney prowded some g~neral ~nformat[on relabng to accessory structures ,which ~nclude sheds and garages. Questions which have ansen relate to whether an Ordinance hm~t~ng the s~ze of sheds and garages ~s reflectwe of community des~res- He stated that there are d~fferent regulations for attached versus detached garages H~s staff has recommended that 600 square foot garages be considered as standard regardless of whether they are detached or attached He also stated that staff would recommend three-car garages be allowed with a Vanat~on approval ~f a defln~bon of hardship can be prowded Consensus of the V,Ilage Board was to endorse the staff recommendabon as outhned by B~II Cooney. Garages will be I,m~ed to 600 s~q~are feet regardless of whether the structure is attached or detached. · Bdl Cooney prowded a general overview of the types of sheds which are currently permitted w~thln the V~llage Code I~m~ts sheds to 120 square feet 'Mr 'Cooney stated that h~s staff has researched the type of sheds generally avadable and feels that the s~ze of the shed should not be related to the lot size The 120 square foot hm~tabon appears to be adequate He stated that only three sheds larger than 120 square feet have been approved by the Vdlage Board ~n the last two years Consensus of the Village Board was to endorse the staff recommendation and retain the 120 square foot limitation on sheds throughout the Village. Commercial Vehicles Bill Cooney prowded some general mformabon to the Board concerning current regulations defimng commercial vehmles He stated that the current defln[bon of commercial vehicles Is not sufficient for Court Generally, within a residential neighborhood, the rule ~s that ~f the commercial vehicle can fit ~n the garage, then that is where ~t should be stored General comments of the Village Board included the following ~nformabon Board members had concerns relabng to advertisements for commercial purposes versus Iogos of businesses which are less obtrusive Some members were also concerned about the consistency of regulatmn and enforcement Consensus of the Village Board was to request staff further hone the recommendations relating to Commercial Vehicle definition and report to the Board whether such regulations which are more clearly defined are enforceable. Dick Bachhuber, 625 South Edward, spoke He stated that whatever regulabons the V~llage Board approves should ~nclude daytime regulations ~n add~bon to n~ght- t~me VI.
