There will be no separate discussion of those items unless a Board member, or resident from the audience, so requests, in which event the item will be removed from the Consent Agenda and considered in its normal sequence on the agenda. OLD BUSINESS A. ZBA 34-01, 1801 Boulder Drive, Residence 2nd reading of AN ORDINANCE GRANTING A VARIATION FOR PROPERTY LOCATED AT 1801 BOULDER DRIVE This ordinance grants variations to allow a shed with a non-conforming setback and size, and easement exceptions. The Zoning Board of Appeals, on October 25, 2001, recommended denial of the request by a vote of 7-0, therefore a super-majority vote is required by the Village Board for approval. (This case was deferred from the March 5, 2002 meeting). ZBA 32-01, 1431 Blackhawk Drive, Residence 1st reading of AN ORDINANCE GRANTING A VARIATION FOR PROPERTY LOCATED AT 1431 BLACKHAWK DRIVE This ordinance grants variations to allow a shed with a non-conforming setback and size, and easement exceptions. The Zoning Board of Appeals, on October 25, 2001, recommended denial of the request by a vote of 5-1, and on January 24, 2002 at the request of the petitioner, the Planning and Zoning Commission deferred the case. Because of the recommendation for denial, a super-majority vote is required by the Village Board for approval. (This case was deferred from the March 20, 2002 meeting). Xl. NEW BUSINESS A. PZ 09-02, 1060 W. Northwest Highway 1. 1st reading of AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP WITH RESPECT TO THE ZONING OF CERTAIN PROPERTY FROM B-1 TO R-2 FOR PROPERTY LOCATED AT 1060 W. NORTHWEST HIGHWAY This ordinance authorizes the rezoning of property from B-1 (Business Office District) to R-2 (Attached Single Family Residence) to allow a 7-unit townhome development. The Planning and Zoning Commission has recommended approval by a vote of 4-2. 1st reading of AN ORDINANCE GRANTING A CONDITIONAL USE PERMIT FOR PROPERTY LOCATED AT 1060 W. NORTHWEST HIGHWAY This ordinance grants a Conditional Use permit for the construction of a 7-unit townhome development. The Planning and Zoning Commission has recommended denial by a vote of 3-3, therefore a super-majority vote is required from the Village Board for approval. PZ 10-02,419 Oriole Lane, Residence 1st reading of AN ORDINANCE GRANTING A CONDITIONAL USE PERMIT FOR PROPERTY LOCATED AT 419 ORIOLE LANE This ordinance grants a Conditional Use permit to allow an unenclosed porch encroaching into the front yard setback. The Planning and Zoning Commission has recommended approval by a vote of 6-0. PZ 11-02,306 N. Owen Street, Residence 1st reading of AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY LOCATED AT 306 NORTH OWEN STREET This ordinance grants variations for the construction of an oversized garage encroaching into the side yard. The Planning and Zoning Commission denied the request by a vote of 6-0. This is an appeal from denial, therefore a super-majority vote is required from the Village Board for approval. 1st reading of AN ORDINANCE AMENDING CHAPTER 23 OF THE VILLAGE CODE OF MOUNT PROSPECT This ordinance deletes Article IV, "Fireworks Discharge; Explosives" as it is duplicated in Chapter 24 in the Village Code. 1st reading of AN ORDINANCE AMENDING VARIOUS CHAPTERS OF THE MOUNT PROSPECT VILLAGE CODE This ordinance amends Chapter 16 (Development) in its entirety, and amends other chapters throughout the Village Code as affected by Chapter 16. LITIGATION 5 ILCS 120/2 (c) (11) - Litigation, when an action against, affecting or on behalf of the particular public body has been filed and is pending before a court or administrative tribunal, or when the public body finds that an action is probable or imminent, in which case the basis for the finding shall be recorded and entered into the minutes of the closed meeting.
